Owner Sentenced for Using Yacht to Smuggle Picasso

Spanish billionaire and owner of 213-foot S/Y Adix Jaime Botín was found guilty of “smuggling cultural goods.” He was fined €52.4 million ($58 million) and sentenced to 18 months in jail on January 16 for breaking a court order prohibiting the removal of a Pablo Picasso piece “from national territory without a permit,” BBC reports. Any piece of art more than 100 years old and deemed culturally significant is registered as a national treasure and requires owners to request permission before taking it outside of the country. The Spanish high court said in 2015 that the painting was of “exceptional importance” because it was created in the Catalan village of Gosol when Picasso was still experimenting with cubism, Forbes reports. Picasso painted Head of a Young Woman in 1906, and Botín purchased it in 1977. The painting was seized from the vessel in Corsica, France, on July 31, 2015, following “an attempt to export to Switzerland,” Boat International says. Prosecutors allege that he hired a private jet to take the painting from Corsica to Switzerland where he intended to sell it. Valued at €26 million, the painting was kept on Adix but would only be on display whenever Botín was on board. Forbes reports that he told a court hearing in November that he asked the captain to keep the painting safe in a box when he was not aboard the vessel. He has fought to take the painting out of Spain since 2012 and even has a case still pending in Spain’s supreme court on the issue. Botín’s lawyers tried to appeal the decision, claiming that the painting was kept on board the yacht, which is British-flagged, and was not technically in Spain. The artwork is now property of the Spanish state and has been given to the Reina Sofia museum in Madrid.

UPDATE: 02/05/2020 The judge who convicted Jaime Botín for smuggling the Picasso piece has published a clarification ruling, Spanish newspaper El País reports. The order issued on January 31 increases his sentence to three years in jail and the fine to €91.7 million ($100.8 million). It’s reported that the correction to the decision was made after the prosecutor’s office and state advocacy requested a review of the calculations.

The 64.86m/212'10" classic yacht 'Adix' (ex. Jessica) was built by Astilleros de Mallorca S.A. at their Palma de Mallorca shipyard. Her interior is styled by design house John Munford and she was completed in 1984. This luxury vessel's exterior design is the work of Dykstra & Partners and she was last refitted in 2014.

Adix has been designed to comfortably accommodate up to 10 guests in 5 suites. She is also capable of carrying up to 14 crew onboard to ensure a relaxed luxury yacht experience.

Range & Performance

Adix is built with a steel hull and steel / teak superstructure, with teak decks. Powered by 1 x diesel MAN (D2848 LXE) 540hp engines, she comfortably cruises at 9 knots, reaches a maximum speed of 10 knots with a range of up to 3,800 nautical miles from her 21,810 litre fuel tanks. Her water tanks store around 8,870 Litres of fresh water. She was built to Lloyds Register ✠ 100A1 classification society rules.

Picasso 'art-smuggler' Jaime Botin denied entry to NZ yet his yacht's in Auckland

A billionaire banker sentenced to three years' prison for smuggling a $44 million Picasso painting out of Spain has been refused entry to New Zealand - but the yacht he attempted the crime on floats in Auckland.

Jamie Botin was convicted of trying to smuggle the Pablo Picasso painting Head of a Young Woman he owned outside of Spanish waters on his 65m yacht Adix in 2015.

The 84-year-old is part of the Santander banking dynasty and has a personal fortune of $2.5 billion. His niece is currently chairwoman of Spain's largest bank, which his great-grandfather founded.

Botin's initial sentence in January 2020 was doubled to three years and he was fined $154m for the crime, but he appealed and still walks free as the case continues.

The yacht Adix which Botin used to take Head of a Young Woman out of Spanish waters, with the alleged intention to sell, now floats in Auckland's Silo Park marina.

The yacht first docked in New Zealand at Opua, Bay of Islands, in December last year and has since sailed down to Auckland to be moored alongside the superyacht of another European billionaire Jim Ratcliffe - who owns Ineos Team UK.

A source in the Auckland marine industry familiar with Adix said Botin himself anticipated he would be able to join his infamous yacht in New Zealand.

"I know the owner is still in court about this Picasso picture, fighting it," the industry source said.

"Yeah, he did try and come [to New Zealand]. Can't get in because of the restrictions. I think the beginning of this year he was supposed to come, January. He just loves sailing.

"I think it's the fourth time the boat is down in New Zealand in its life. The two captains, they both rotate, there's a Kiwi captain on board now. They cruise around the world all the time."

The Ministry of Health confirmed Adix was granted permission to enter New Zealand under a "refit and repair" maritime border exemption in November last year.

Immigration NZ advised they issued visas to 11 crew members of Adix and a 12th crew member on board was a New Zealand citizen.

The refit and repair maritime border exemption provides criteria for yachts to enter New Zealand, along with any international crew, provided they spend $50,000 in maintenance work at a local marine yard.

Botin, whose nephew Marcelino is the principal designer for American Magic America's Cup team, was originally charged with taking the Picasso painting out of Spain in 2015 by the Spanish Government, which had imposed a national protection order on the painting for its significance to Spanish heritage.

Spain has some of the strictest heritage laws in Europe and authorities can deem a work of art more than a century old a national treasure for its cultural importance.

Spanish authorities had already begun to monitor Botin in 2012 after Christie's auction house asked for an export licence to put Head of a Young Woman up for sale.

The Spanish Government refused the licence, also forbidding Botin to take the painting outside the country.

However, in 2015 Botin's son Alfonso took Adix to the French Mediterranean island of Corsica.

Working from a tip-off, French customs officials boarded the yacht in Calvi on the French island of Corsica, found the painting packaged up and seized it.

Prosecutors subsequently alleged Botin intended to take the painting to Switzerland to sell. It was taken to the Reina Sofia Museum in Madrid, where it remains.

Botin claimed he was transporting Head of a Young Woman to Geneva for safe storage and that the painting was rarely ever on Spanish soil during his ownership anyway.

The banker acquired the Picasso in 1977 and it has hung in the Adix yacht for many decades.

Head of a Young Woman is from Picasso's pink period and one of only a few existing paintings he painted in 1906 in the village of Gosol in Catalonia.

At one point, a floating art collection adorned the Adix including works by JMW Turner and Camille Corot.

Botin bought Adix in 1990 off Australian industrialist Alan Bond, who famously bankrolled his country's successful challenge for the America's Cup in 1983.

Adix had been built in Mallorca in 1984 and christened Jessica by her original Argentine owner. Bond bought her a few years later and changed her name to XXXX, which is a brand of beer he owned in Queensland at the time.

Aside from his appeal case and inability to enter New Zealand, it is not all bad news for Botin, who in January was awaiting one of the largest individual dividends in the history of Spanish banking.

He is set to receive $17.5m from his shares in his Santander family bank.

This three masted schooner was originally named ‘Jessica’, owned by an Argentine, and rigged with square sails on her foremast. She had a significantly shorter length overall in comparison to her 212′(65m) now.

In the mid-late 1980’s she was bought by Alan Bond who used her as a promotional tool and who crudely named the yacht after his beer, ‘XXXX’.

Around 1989 XXXX was bought by a Spanish family, who employed Paul Goss as the Captain who undertook a massive project in refining her looks. He worked with the expertise of the naval architect Gerard Dijkstra. The subsequent refit included cutting the hull in half and adding a section, creating a different underwater configuration and lengthening her spas.

Since then ‘Adix’ has been around the world a number of times turning heads wherever she sails. She attended the Fife Regatta on the Clyde in 2003 and 2008 with her ‘tender’, ‘ The Lady Anne ‘. She has been based out of Valencia since the 2007 America’s Cup event and has carried out extensive refits at Pendennis Shipyard in 2001 and 2009.

2014 finds her back in Pendennis again, this time for a serious upgrade that includes reinforcing the hull, with new longer carbon masts and carbon rigging. More in our article here.

Adix launches after an eight-month refit at Pendennis

After completing an eight-month refit, luxury sailing superyacht Adix has been launched. The extensive refit programme at Pendennis included a redesign of her deck house, the addition of new portholes on each side and an overhaul of her engineering.

The revamp of her deck house moved it further forward, and added a seating area to allow better interaction with the owner’s accommodation. As part of the refit, Adix was given new generators and had a main engine, bow thruster and rudder installed.

This was the fourth refit of Adix at Pendennis, based in Falmouth in England. Built in Spain in 1984 to an Arthur Holgate design, Adix had her first transformation back in 1991 when she underwent underwent a transom modification and full interior strip out, with design by Dykstra Naval Architects . This remodelling programme saw her named as ‘Best Refit’ in the ShowBoats Awards that year.

The three-masted, 370 tonne schooner, originally called Jessica and for a time renamed as XXXX by then-owner Alan Bond, who recently passed away , to promote his beer brand, is still one of the largest sailing yachts built since the 1930s. Adix has competed twice in the Pendennis Cup, a regatta for classic and modern yachts 30m+ organised by the yard off Falmouth.

In March, Malahne was launched after a painstaking 30-month restoration , hailed as one of the most ambitious of all time. The yacht is the cover star of the August issue (out now), which includes exclusive photos of her new interior and the story behind her restoration. She's widely regarded as one of the best British superyachts of all time since her restoration.

The yacht was originally brought to the yard in 1991 to undergo a complete programme of refit and repair, including a transom modification, 6m extension and full interior strip out. She has since paid subsequent visits to our yard in 2001, 2008, 2014, and 2022. During her 2009 visit Adix underwent scratch and gloss paint work, Lloyd’s and MCA surveys with a major engineering overhaul on her generators and main engines and cosmetic work on her external deckhouses. At the time the 370 tonne three masted schooner was the largest yacht to be lifted out by Pendennis’ 400 tonne travel hoist. Adix returned to Falmouth in April 2014 to compete in the fourth edition of the Pendennis Cup following which she was hauled out to begin a comprehensive 8-month refit programme. The Schooner underwent engineering works which included the installation of new generators and main engine, the yacht’s weight was assessed and the ballast was reconfigured to improve her weight by over 18 tonnes. Paintworks were completed in situ whilst she was based in one of our 90m construction halls. The Pendennis team redesigned the yacht’s deck house, which was moved further forward and combined with a seating area to provide better interaction with the Owner’s accommodation. After enjoying the summer cruising period Adix returned for final topside works including new lighter carbon and titanium rigging to complete her refit. After departing Falmouth, Adix continued to receive remote assistance from our Yacht Support team in locations around the globe, before returning for a short visit to the yard in 2022. She has recently departed to continue her adventures.

Sailing Superyacht Adix Begins Refit at The Yard Brisbane

The 64.85 metre sailing superyacht Adix has begun a four month refit and Lloyds survey period at The Yard Brisbane (TYB) in Australia.

The three masted schooner, which was built in Spain 1984 to an Arthur Holgate design, is currently cruising the South Pacific in the run up to the America’s Cup in Auckland in 2021.

While having a long-term refit relationship with the Pendennis yard in Cornwall, the Adix team selected TYB to undergo maintenance work while the yacht is based in the Southern Hemisphere.

Speaking about the yacht’s arrival at the yard, international development manager Mark Phelps said: “We recognise that while looking for facilities in the Southern hemisphere the Adix team would have been measuring every facility against their ‘home’ shipyard Pendennis, a highly respected Northern European yard. To be selected as their yard of choice supports our belief that we hold a place on the world refit stage.”

He added: “ Adix is a truly iconic yacht and we are delighted to have her visit us.”

Captain Paul Goss explained that TYB’s extensive facilities, which include two high clearance refit halls of 90 and 70 metres, were key in selecting the yard.

“ Adix occupies a lot of space when you lay the three rigs on the ground–the sum of Adix’s spars laid end to end is over 220-metres. The Yard Brisbane’s spacious facilities, particularly their refit sheds, were excellent in that respect,” he said.

It comes after Adix completed an eight-month refit at the Pendennis yard in July 2015. The extensive programme included a redesign of the deck house, addition of new portholes and engineering overhaul.

Adix’s first transformation took place in 1991, when the yacht underwent underwent a transom modification and full interior strip out, with design by Dykstra Naval Architects . This remodelling programme saw Adix named as ‘Best Refit’ in the ShowBoats Awards that year.

This three masted schooner was originally named ‘Jessica’, owned by an Argentine, and rigged with square sails on her foremast. She had a significantly shorter length overall in comparison to her 212′(65m) now.

In the mid-late 1980’s she was bought by Alan Bond who used her as a promotional tool and who crudely named the yacht after his beer, ‘XXXX’.

Around 1989 XXXX was bought by a Spanish family, who employed Paul Goss as the Captain who undertook a massive project in refining her looks. He worked with the expertise of the naval architect Gerard Dijkstra. The subsequent refit included cutting the hull in half and adding a section, creating a different underwater configuration and lengthening her spas.

Since then ‘Adix’ has been around the world a number of times turning heads wherever she sails. She attended the Fife Regatta on the Clyde in 2003 and 2008 with her ‘tender’, ‘ The Lady Anne ‘. She has been based out of Valencia since the 2007 America’s Cup event and has carried out extensive refits at Pendennis Shipyard in 2001 and 2009.

2014 finds her back in Pendennis again, this time for a serious upgrade that includes reinforcing the hull, with new longer carbon masts and carbon rigging. More in our article here.

In 2014, ADIX yacht sailed to the Falmouth to take part in the Pendennis Cup. Following she was hauled out to start a comprehensive 8-month refit. She has had engineering works done, including new generators and main engine replacement. Luxury yacht ADIX also had a new paint job and the Pendennis team redesigned the yacht's dec house, which was moved further forward. It was combined with a seating area which now offers more comfortable interaction with the Owner's stateroom.

The 65m superyacht ADIX offers comfortable, elegant and deluxe accommodation to up to 10 guests on board. She is serviced by a crew of 10 professional and highly skilled members.

The Unique Burial of a Child of Early Scythian Time at the Cemetery of Saryg-Bulun (Tuva)

In 1988, the Tuvan Archaeological Expedition (led by M. E. Kilunovskaya and V. A. Semenov) discovered a unique burial of the early Iron Age at Saryg-Bulun in Central Tuva. There are two burial mounds of the Aldy-Bel culture dated by 7th century BC. Within the barrows, which adjoined one another, forming a figure-of-eight, there were discovered 7 burials, from which a representative collection of artifacts was recovered. Burial 5 was the most unique, it was found in a coffin made of a larch trunk, with a tightly closed lid. Due to the preservative properties of larch and lack of air access, the coffin contained a well-preserved mummy of a child with an accompanying set of grave goods. The interred individual retained the skin on his face and had a leather headdress painted with red pigment and a coat, sewn from jerboa fur. The coat was belted with a leather belt with bronze ornaments and buckles. Besides that, a leather quiver with arrows with the shafts decorated with painted ornaments, fully preserved battle pick and a bow were buried in the coffin. Unexpectedly, the full-genomic analysis, showed that the individual was female. This fact opens a new aspect in the study of the social history of the Scythian society and perhaps brings us back to the myth of the Amazons, discussed by Herodotus. Of course, this discovery is unique in its preservation for the Scythian culture of Tuva and requires careful study and conservation.
