Anil Ambani gifts wife Tina Luxury Yacht worth $ 84,000,000

anil ambani yacht

The battle between India’s wealthiest and powerful brothers –Anil and Mukesh Ambani, has reached another level. Close on the heels of his brother Mukesh Ambani gifting a Rs 250crore ($52,362,298) corporate jet to wife Nita last year; younger brother Anil has outdone his brother by buying his wife, Tina a super luxury yacht estimated to cost a whopping Rs 400 crore ($83,784,070). This super luxury yacht is made in Genoa, Italy. Also if rumors are to be believed, it has been a long-cherished dream of Tina to own a luxury yacht and thanks to billionaire hubby, her dream has finally become a reality. The yacht has been named Tian (combining the first two letters of both Tina and Anil’s names), rather unimaginative if you ask me. The couple plans to bring in the New Year on their newly acquired luxury yacht, which is currently anchored near the Gateway of India. Tian is about 34 meters long and costs around Euro 34 million ($47 million) to build.

According to sources, the cost of each running meter of luxury yachts is Euro 1 million ($1.4million). Thus, taking the final cost to around Rs 400 crore, inclusive of customs and excise duties and refurbishing, add sources. Owning this yacht has placed Tina in an exclusive club of Gautam Singhania and liquor baron Vijay Mallya, who also own luxury yachts. Looks like when it comes to pleasing their lovely ladies the two brothers will do almost anything. Source

Tina Ambani to buy 100m luxury yacht for Rs200 crore

Super buy: Tina Ambani is looking at a larger version of a luxury boat.

Mumbai: Tina Ambani, wife of billionaire Anil Ambani, who leads the Reliance Anil Dhirubhai Ambani Group, or R-Adag, is buying a yacht worth nearly Rs200 crore ($46.8 million).

The former Bollywood actor has chosen a 100m-long yacht that can host at least 20 people besides the crew, said a person familiar with the development. She has also applied for membership at the 161-year-old, Mumbai-based Royal Bombay Yacht Club, or RBYC.

anil ambani yacht

An email Mint sent to the executive assistant of Tina Ambani remained unanswered and an R-Adag spokesperson said he could not comment.

“She had applied for a membership some time back," said RBYC secretary Suresh Kumar. “We are processing her request and she will get a membership shortly. However, I am not aware about her yacht-buying plans."

An RBYC membership enables an individual or company to enjoy various sailing and training programmes the club undertakes. The club also offers maintenance support and anchor space.

Ambani’s yacht is “special." “She is looking at a larger version of a luxury boat that can be used for long cruises with multiple cabins and plush interiors," said the same person who did not wish to be identified.

Going by the technical specifications revealed by this person, Ambani’s yacht will be like Mallya’s 95m Indian Empress, which is powered by three 10,000hp engines.

Incidentally, Anil Ambani’s estranged elder brother and chairman of India’s largest private company Reliance Industries Ltd, Mukesh Ambani, had gifted his wife Nita Ambani a luxurious Airbus 319 corporate jet worth nearly Rs250 crore last year.

Last week, Forbes magazine named Tina Ambani as one of the 10 billionaires’ wives who have impressive independent credentials. In 2004, she founded the Harmony for Silvers Foundation, a non-government organization that works towards improving the life of old people.

The Harmony Interactive Centre, operating since May 2004, provides an opportunity for senior citizens or “silvers" to interact with their peers in a space of their own and also aims at educating the general public about issues the elderly face.

Her husband, Anil Ambani, is the sixth wealthiest person in the world and founder of R-Adag that has a net worth of Rs55,000 crore.

“I cannot comment on Tina Ambani buying a super yacht. If it is a super yacht, it will be an exceptional buy," said Shakeel Kudrolli, managing director of Acquasail Pvt. Ltd that represents Chantiers Beneteau SA, a leading yacht company.

“But I can only say that India is increasingly catching up with the US and Europe when it comes to buying specialized yachts. It is not uncommon that high networth individuals buying yachts after owning other premium products such as a BMW and other pricy possessions," he said.

Kudrolli, who has been into sailing for the past 35 years and launched the part ownership concept in yachts, said that companies are buying more sophisticated sports-cum-leisure boats to offer special hospitality to their premium customers instead of taking them to conventional five-star hotels.

“Some of the corporations are buying yachts for meetings and leisure activities for internal teams, while some are using sailing as team-building exercise," he said.

By Gaurav Sonavane

Not Mukesh Ambani but this Indian billionaire owns the costliest yacht

The number of billionaires in India has increased to 169, up from 166 in the previous year, according to Forbes' 2023 annual billionaires list.

These Indian billionaires are known for their extravagant lifestyles, own luxurious vehicles and reside in lavish mansions worth crores. While many have invested in private jets, only a select few like Mukesh Ambani, Gautam Singhania , Anil Ambani and others own a yacht. However, there's one Indian billionaire who stands out from the rest for owning the world's most expensive yacht, worth over Rs 1,000 crore.

Meet the Indian billionaire with a net worth of Rs 1,35,282 Crore who owns a yacht worth over Rs 1,000 Crore, and it's not Gautam Adani or Mukesh Ambani

According to DNA , Indian billionaire Lakshmi Mittal owns a 262 metre Amevi superyacht that is worth a whopping $125 million (approximately Rs 1,037 crore). Designed by renowned interior designer — Alberto Pinto (in 2007), the superyacht comes with a heated swimming pool, a grand sky lounge, a cinema hall, a well-equipped gymnasium, a massage room, a stabilized pool table and a helipad, according to Yachtbible.com . The report also stated that the superyacht owned by Mittal can accommodate around 16 guests in 8 VIP suites and 22 staff members in 10 cabins.

With a net worth of $16.3 billion (approximately Rs 1,35,282 crore), Lakshmi Mittal, Chairman of ArcelorMittal, one of the world's largest steel manufacturing companies, commissioned the Amevi superyacht in 2007, which was designed by the renowned Italian yacht design studio, Nuvolari Lenard. The yacht is equipped with a twin diesel MTU (16V 595 TE70) 16-cylinder engine, allowing it to comfortably reach up to 14 knots, according to Yachtbible.com .

Another prominent billionaire who owns a luxurious palace on the water is Mukesh Ambani. The 58-metre-long and horseshoe-shaped luxury yacht set the 66-year-old Indian business magnate back by $100 million (approximately Rs 829 crore), according to DNA . The report also stated that Mukesh Ambani's younger brother Anil Ambani also owns a yacht named TIAN worth around Rs 200 crore.

Income Tax Appellate Tribunal reprieve for Anil Ambani in yacht customs duty case

Reliance Communication chairman Anil Ambani (File Photo | PTI)

NEW DELHI: Failed industrialist Anil Ambani got a much-needed reprieve from the Income Tax Appellate Tribunal (ITAT) when it rejected a tax department plea that accused Anil Ambani of claiming a deduction on customs duty paid on a yacht used for personal purpose.

The tax department had raised the tax demand after it claimed that customs duty paid on the yacht could not be treated as business expenditure as the same was used for personal purposes of Anil Ambani and his family.

However, the Mumbai bench of the ITAT rejected the tax department's plea saying that the yacht was purchased by Anil Ambani's company Reliance Transport and Travels Pvt Ltd, and that the same is used for business purposes.

FROM OUR ARCHIVES | Anil Ambani resigns as director of Reliance Power, Reliance Infrastructure

The tribunal also noted that revenue from operations of the yacht was reported as business income and the same was accepted by the tax department in all the years. The appellate tribunal thus agreed that Anil Ambani's company in the course of its business hired the yacht for the use of its business and to provide services to other entities and companies.

The case pertains to assessment year 2013-14. Reliance Transport and Travels had debited Rs 32.12 crore as customs duty, out of which Rs 26.49 crore was claimed as business expenditure paid for the yacht.

Companies can deduct business expenditure from taxable revenue thus bringing down their tax liabilities. Often the tax department rejects business expenditures claims of companies, and this is one of the major reasons for a large number of tax litigation.

The tax department had also contended that the customs duty was paid in 2009 and not in the assessment year 2013-14. However, the appellate tribunal rejected the contention of the tax department saying that the said duty was only crystallised in AY2013-14 after determination by Customs and Excise Settlement Commission.

Super-rich flaunt Yachts as their new symbols of wealth

The most impressive indian yacht, however, is vijay mallya's indian empress, bought in 2006, for an estimated 72 million..

Anil Ambani bought one for his wife, Tina, six years ago. Vijay Mallya has one, so do Adi Godrej, Gautam Singhania and real estate baron Sunny Wadhawan. India has yet to see a booming yacht business - and the number of luxury yacht owners is barely 50 - but a beginning has been made.

There are, however, limits to customization. Classification societies in different countries lay down specifications for marine vehicles which have to be adhered to. The European Union, for instance, has a recreational craft directive (RCD) for boats between 2.5 and 24 metres. These relate not only to the engine but also the interiors - locations of bedrooms and bathrooms cannot be arbitrarily changed as this might affect weight distribution of the vehicle. "We have to meet RCD norms," says Gautama Dutta, Director, Marine Solutions. Still, cabins can be merged to make them bigger or a salon or bar added, if the customers asks. Indian customers, company sources added, were primarily interested in the appearance of the yacht rather than technicalities.

Anil Ambani may not be a billionaire anymore — here's how he lost it all in just a decade

The peak of 2008: $42 billion.

He has been on a slippery slope since then. Once touted to be the sixth richest in the world-- in 2008, he was worth a whopping $42 billion according to Forbes -- today he has reportedly crashed out of the billionaire’s club, although hough Forbes real-time data says that he is worth $1.5 billion.

He was also known to buy his wife, former Bollywood actor Tina Ambani, a yacht worth ₹4 billion in 2008 but by the end of the same year, he lost $30 billion as stock markets crashed, and his net worth dropped to $12 billion. He topped Forbes’ list of ‘Billionaire Blowups of 2008’.

2011: $8.8 billion

By 2010, the markets had recovered but the rosy picture painted by his companies had started waning. His now bankrupt Reliance Communications still held promise as it was busy buying 3G spectrum and the company’s dongle business was still technologically relevant. And, he also purchased coal mines in Indonesia to power his electricity-producing business. His net worth had recovered from the lows to $13.7 billion. But that didn’t last long.

The next year was also bad as 2G scam where 122 telecom licences were lost, also got him into trouble. He was questioned by the Central Bureau of Investigation (CBI) for the role he played in promoting Swan Telecom, which had discrepancies around it. His net worth had dropped to $8.8 billion by the end of 2011.

2013: $5.2 billion

By 2013, his fortunes declined in spite of the fact that his power company was losing steam and was planning to give up troubled power plants like Krishnapatnam, which were turning out to be money pits even before they were built. Reliance Infrastructure however was chugging along with high-profile projects like Mumbai Metro under construction. His net worth had declined to $5.2 billion.

2016: $2.5 billion

His net worth halved to $2.5 billion in 2016 when the group changed strategy from growth to asset sales. Reliance Power had put assets on the block and was planning to return to projects that it couldn’t sell like Krishnapatnam. The CDMA business of RCom was closed and the subscribed were migrated to GSM networks. And, Ambani had started eyeing his big brother Mukesh Ambani’s entry into telecom as a savior. “A deal of some sort is imminent,” he would repeat at annual general meetings.

2017-2019: The final descent

In 2018, he managed to sell Reliance Infrastructure’s Mumbai power distribution business to Gujarat based Adani Group, and also Tilaiya power project. But, its company Reliance Naval was dragged to bankruptcy by its lenders. His networth was at $2.7 billion.

In 2019, came the biggest hit to Anil Ambani as Reliance Communications went into bankruptcy and was ordered by the Supreme Court to pay up the dues to vendor Ericcsson or go to jail. He was bailed out by big brother Mukesh Ambani who shelled out ₹4.5 billion, a day before he was supposed to go to jail.

Skeletons in the Closet

In the last one month, his group has been slipping down the rabbit hole as auditors of two of his companies, Reliance Capital and Reliance Infrastructure pointed out discrepancies in the workings of the company group. The latter’s auditors, Pathak H D & Associates said that there is money missing on their balance sheet, and are worried about the ability of the company to carry on as a going concern.

Meet Billionaire Owner Of The World's Most Expensive Yacht Amevi; It's Worth Rs 1,000 Crore

Gursharan

It's not news that the world's top billionaires own ridiculously expensive things, from luxury cars to opulent houses and private jets. We have all witnessed that the ultra-rich have a penchant for all things luxury.

But the world's most expensive yacht, the Amevi superyacht, can put even the most extravagant things. And it is owned by none other than the steel magnate Lakshmi Mittal.  Here's all about Amevi.

amevi

All about  superyacht  Amevi

Mittal owns a 262-metre Amevi superyacht worth around Rs 1,000 crore. The yacht has a swimming pool, gymnasium, spa and cinema hall. Amevi features a magnificent sky lounge, offering panoramic views and a large terrace to get to the sun decks. It also features a massage room, salon, helipad, and stabilised pool table.

The Amevi superyacht was built in 2007 by Oceanco, a shipyard based in the Netherlands and designed by Nuvolari Lenard. Oceanco is a team of experts who merge the expertise of old-world Dutch craftsmanship with cutting-edge technology to create unparalleled masterpieces.

Renowned luxury yacht designer Alberto Pinto has designed the interiors of Amevi. It accommodates 16 guests in its 8 VIP rooms and can carry over 20 crew members.

The owner's suite on the upper deck features a cut above the rest with a full-beam design. It also includes a lounge and private outdoor space with two jacuzzis.

The yacht has twin MTU 16V 595 TE70 engines with a total power of 9,100 HP (6,800 kW). The yacht reaches a maximum speed of 18.5 knots or 34.3 kmph, with a cruising speed of around 14 knots or 26 kmph.

Ranked the 7th richest Indian globally, Mittal has embarked on voyages to India, Spain, Gibraltar, and Norway aboard his lavish yacht.

Other prominent Indian billionaires who possess yachts include Mukesh Ambani, Anil Ambani, Adi Godrej and Gautam Singhania, among others.

Mukesh Ambani, Asia's richest man, reportedly owns an ultra-luxury yacht shaped like a horseshoe, boasting a mind-boggling cost of $100 million. Stretching an impressive 58 meters, the yacht is replete with luxurious amenities, including private suites, a spa, a 25-meter swimming pool, and a lounge bar.

Not to be outdone, his younger brother Anil Ambani, accompanied by his wife Tina Ambani, also purchased a yacht named TIAN, though the exact cost, rumoured to be around Rs 200 crore, remains undisclosed.

Former billionaire Vijay Mallya once used to own a yacht named the Empress of India, which he had bought for an undisclosed amount in 2006. Mallya said in 2018 that the 95-metre yacht was sold for 43.5 million.

Anil Ambani Says 'Vegetarian, Teetotaler, Non-Smoker' Amid UK Case

Anil Ambani said that a judge was wrong to say he'd lived a lavish lifestyle.

Former billionaire Anil Ambani rejected a judge's comment that he lived a "lavish lifestyle" as he faced questions about his assets from lawyers acting for a trio of Chinese banks.

Ambani was giving evidence via videolink for the first time from Mumbai, in a English lawsuit over a dispute stemming from a defaulted loan. The tycoon, who has previously said his net worth is "zero," was questioned about his spending and his finances, including more than $100 million in family loans.

Three state-controlled Chinese banks have pursued Ambani for more than $700 million in a London court, arguing that they provided funding to his Reliance Communications Ltd. in 2012 with the condition that he personally guarantee the debt. After winning a ruling requiring Ambani to make the payments, the banks have yet to receive any funds.

"He's fighting tooth and nail to prevent having to pay us a penny," the banks' attorney, Bankim Thanki, said of Ambani.

Ambani, the younger brother of Asia's wealthiest man, said that a judge was wrong to say he'd lived a lavish lifestyle, insisting that he was a marathon runner who didn't drink, smoke or gamble.

"I think I must put it respectfully in perspective," Ambani said. "My needs are not vast and my lifestyle is very disciplined."

"Any suggestion of a lavish lifestyle past, present and future is completely speculative," he said.

Ambani was accused of putting his assets out of the reach of his creditors by putting the ownership in corporate entities. The family art collection was owned by his wife, he said. The luxury motor yacht, which was used family members -- but not Ambani himself, who said he suffered from seasickness -- was also owned by a company, he said.

Ambani had always said he never made a personal guarantee -- something he'd dismissed as an "extraordinary potential personal liability."

On Friday, Ambani was examined over credit-card spending in luxury shops including Harrod's that he said was done by his mother on his cards. He was also questioned over a $66 million loan provided by his mother, Kokilaben Ambani, and a $41 million loan from his son. He said he couldn't recall the terms of the loans but insisted they weren't gifts.

The former billionaire "has always been a simple man of simple tastes, contrary to exaggerated perceptions of his flamboyance and lavish lifestyle," a spokesman for Ambani said in a statement. "He is also a lifelong vegetarian, teetotaller and non-smoker who would much rather watch a movie at home with his kids than go out on the town."

Before the luxury of Antilia: An inside look at Mukesh and Anil Ambani’s former

The  Sea Wind, Mumbai:  Reliance Industries chairman Mukesh Ambani continues to grow his business. At 67, he has partnered with several international companies to launch services in different sectors. Reliance, led by Ambani, is one of India's largest companies . Nita and Mukesh Ambani’s home, Antilia , is perhaps the most famous private residence in the country.

This 27-storey tower stands in one of the world’s most expensive real estate areas and ranks as the second most valuable property after Buckingham Palace.

In another era, Mukesh and Anil Ambani shared their family home . Both brothers were being groomed to take over their father Dhirubhai Ambani’s empire until a public falling out after his death in 2002 split the Reliance empire in half. Over the past 20 years, their fortunes have diverged sharply. Mukesh Ambani has become one of the richest people globally, while Anil Ambani, despite claims to a UK court that his net worth was “zero,” has seen his wealth diminish significantly from billionaire to millionaire status.

Before moving into Antilia in 2011, Mukesh Ambani and his family lived in the same building as Anil Ambani’s family. Both brothers hold their mother Kokilaben in high regard, who also resided there.

The brothers once shared Sea Wind, an entire building in Mumbai’s Cuffe Parade. Unlike the lavish Antilia, Sea Wind is more modest at 19 stories high. It served as the Ambani residence for a considerable period and was their father Dhirubhai Ambani’s home.

Sea Wind is far less grand than Antilia, lacking ultramodern features like high-speed elevators or snowflake-spitting rooms. Each family member had a spacious floor to themselves, including the children. Today, Anil Ambani and his family reside in Sea Wind, where Kokilaben also chose to stay rather than moving into Antilia.

Anil Ambani - Tendulkar

New Delhi: A global investigation has revealed how some of the world’s richest and most powerful people, including several prominent Indians, allegedly used offshore companies to conceal their wealth from tax authorities.

The investigation, termed as the ‘Pandora Papers’, is based on nearly 12 million documents obtained by the International Consortium and Investigative Journalists (ICIJ). It was published by The Indian Express in India.

According to the ICIJ website , an investigation into the “offshore havens” and “hidden riches” of world leaders and billionaires”, is based on confidential records of 14 offshore service providers located in British Virgin Islands, Panama, Belize, Cyprus, the United Arab Emirates, Singapore and Switzerland, which helped these wealthy individuals to “incorporate shell companies, trusts, foundations and other entities in low- or no-tax jurisdictions”.

Anil Ambani, Sachin Tendulkar, Nirav Modi’s sister named

The leaked documents revealed offshore dealings of Reliance Group chairman Anil Ambani, cricket legend Sachin Tendulkar, fugitive diamond businessman Nirav Modi’s sister Purvi Modi, the husband of Biocon chairperson Kiran Mazumdar-Shaw, among others.

According to the report in The Indian Express , many individuals and businesses, already under the scanner, are “pushing the envelope to evade detection, using loopholes in the law at home and the lax jurisdiction of tax havens”.

Of the 300-plus Indians figured in the list, the report highlighted how “bankrupt” Anil Ambani and his representatives own 18 asset holding offshore companies worth $1.3 billion in Jersey, British Virgin Islands (BVI) and Cyprus.

Following the revelations by the newspaper, Ambani’s lawyer said , “Our client is a tax resident of India and has made disclosures to Indian authorities as required to be made in compliance with law. All required considerations were taken into account when making disclosures before the London court”.

The list also named fugitive diamond jeweller Nirav Modi’s sister, Purvi Modi. According to the documents, Purvi set up a trust in the British Virgin Islands to act as a corporate protector of a trust formed through the Trident Trust Company, Singapore.

The trust was set up a month before Nirav fled India in January 2018.

In response to The Indian Express’ request for a comment on the revelations, Manavendra Mishra, lawyer of Purvi Modi, said , “We are the lawyers acting for Ms Purvi Modi in India. We deny all the below allegations raised in your email. We are not in a position to respond or comment at this stage since the matter is sub-judice before the special PMLA court.”

The leaked documents also name Sachin Tendulkar, with wife Anjali Tendulkar and father-in-law Anand Mehta, as Beneficial Owners and Directors of Saas International Limited, a company based in the British Virgin Islands. The company was reportedly liquidated three months after the Panama Papers expose.

Speaking to The Indian Express , Mrinmoy Mukherjee, CEO and Director of Sachin Tendulkar Foundation, said : “The referenced investment by Mr. Tendulkar has been made by him from his tax paid funds under the Liberalised Remittance Scheme (LRS) and has been duly accounted for and declared in his tax returns.

Another report said John McCallum Marshall Shaw, a British citizen and husband of Kiran Mazumdar-Shaw, promoter of Biocon, set up ‘The Deanstone Trust’ with Kunal Ashok Kashyap, who was banned by Sebi for insider trading.

Asked about this connection with Kashyap, Kiran Mazumdar-Shaw told The Indian Express : “Mr Kunal Kashyap runs a financial advisory service and has been used by Biocon as well as Glentec. Mr Kashyap advises several companies apart from Biocon. I understand that Mr Kashyap’s SEBI case is currently pending with SAT (Securities Appellate Tribunal) and hence it would not be appropriate for me to comment on this any further.”

World leaders

Globally, the prominent leaders who allegedly used tax havens to stash their funds include former UK prime minister Tony Blair, ministers in Pakistan PM Imran Khan’s cabinet, and King of Jordan among others.

Putin’s image-maker

Russian President Vladimir Putin’s image-maker, Konstantin Ernst , who is also a television executive and Oscar-nominated producer, is said to have become “a silent partner, hidden behind layers of offshore companies, in a state-funded privatization contract to buy dozens of movie theaters and other property from the city of Moscow”.

According to the documents, the value of Ernst’s personal stake in the property holdings topped $140 million.

Imran Khan’s cabinet ministers

The documents reveal offshore holdings of Pakistan Prime Minister Imran Khan’s current and former cabinet ministers, including his finance minister.

The documents also show that Pakistan’s minister for water resources, Chaudhry Moonis Elahi, contacted a Singapore-based offshore services provider in 2016 to set up a trust to invest the profits from a family land deal, which, according to the lender, was an illegal loan. The bank said the loan had been approved due to the influence of Elahi’s father, a former deputy prime minister, the report said.

Czech PM bought lavish property in France

The leaked records show that, in 2009, Czech Prime Minister Andrej Babis, one of the richest man in his country, injected $22 million into a string of shell companies to buy a sprawling property, known as Chateau Bigaud, in a hilltop village in Mougins, France, near Cannes.

The report says Babis has not disclosed the shell companies and the chateau in the asset declarations he’s required to file as a public official.

Tony Blair’s property

Former UK Prime Minister Tony Blair avoided having to pay £312,000 in stamp duty when buying a £6.45m London townhouse in 2017. The property was an office for his wife Cherie’s business and they bought the offshore firm that owned it.

King of Jordan

Jordan’s monarch, King Abdullah II, bought three beachfront mansions in Malibu that were purchased through three offshore companies for $68 million in the years after Jordanians filled the streets during Arab Spring to protest joblessness and corruption.

Delhi Airport Metro: SC's relief to DMRC, quashes arbitral award in favour of Anil Ambani firm

New Delhi [India], April 10 (ANI): The Supreme Court on Wednesday quashed its 2021 judgment that directed the Delhi Metro Rail Corporation (DMRC) to pay Reliance Infrastructure subsidiary, Delhi Airport Metro Express Private Limited (DAMEPL), an arbitral award running into a few thousand crores.

A bench of Chief Justice DY Chandrachud and Justices BR Gavai and Surya Kant also directed that any amount deposited by the DMRC has to be refunded.

"The part of the awarded amount, if any, paid by the petitioner (DMRC) as a result of coercive action is liable to be restored in favor of the petitioner," the judgment stated.

The bench held that the "division bench applied the correct test in holding that the arbitral award suffered from the vice of perversity and patent illegality".

It said the September 2021 judgment of the apex court interfering with the 2019 High Court judgment 'resulted in a miscarriage of justice".

"In the specific facts and circumstances of this case...we have come to the conclusion that this court erred in interfering with the decision of the division bench of the High Court. The judgment of the division bench provided more than adequate reasons to come to the conclusion that the arbitral award suffered from perversity and patent illegality," the verdict of the top court stated.

It further added, "By setting aside the (2019) judgment of the division bench, this court (in September 2021) restored a patently illegal award which saddled a public utility with an exorbitant liability. This has caused a grave miscarriage of justice..."The arbitral tribunal award was upheld by a single-judge bench of the Delhi High Court in 2018, but it was struck down by a division bench of the High Court in 2019.

The Anil Ambani-owned Reliance Infra approached the Supreme Court against the High Court's division bench decision striking down the award.

A two-judge bench of the top court in 2021 reversed the High Court judgment by the division bench and restored the arbitral tribunal award. The DMRC's plea seeking review of the September 2021 judgment too was dismissed in November 2021.

Thereafter, in 2022, DMRC moved a curative petition questioning the September 2021 judgment on the point of law.

Gandhi's Moscow flight raises questions in India

By Anand Giridharadas

  • June 15, 2005

MUMBAI, India — When Sonia Gandhi, the boss of India's ruling Congress Party, touched down on a Moscow tarmac on Monday, it was in a Bombardier jet whose only marker was a head-sized gold logo approximating the letter "R."

It was no ordinary "R." It stands for Reliance, the $23 billion business concern that is India's largest and is the subject of a venomous family dispute roiling India's media, dividing its politicians and spurring numerous federal investigations.

The jet's usage on a foreign visit, which previously has not been reported, strikingly juxtaposes Gandhi's face with the Reliance logo at a time when Gandhi's Congress-led governing coalition is engaged in multiple, parallel investigations into alleged misdeeds at the conglomerate, including improper stock trading, document forgery and account fudging.

These allegations have surfaced as Mukesh and Anil Ambani, the sons of Dhirubhai Ambani, Reliance's founder, wage a campaign of mutual sabotage in seeking to wrest control of the group, whose interests span textiles, insurance, oil refining and mobile phones.

Gandhi arrived in Russia on Monday morning for a four-day visit as a private guest of President Vladimir Putin. Her visit follows a recent flurry of Indian visits to Moscow, by the prime minister, president and petroleum minister. Russia's vast energy reserves and India's booming energy needs are among the topics fueling recent interactions.

Regardless of who paid for the flight, the specter of Gandhi descending from the Reliance jet under a Moscow drizzle cut an image that could open her to criticism.

An Indian government official said the plane had been chartered from Reliance and it was his "understanding" that the Congress Party had paid.

"They looked around and found a plane, and coincidentally it belonged to Ambani," said the official, who declined to be named because Gandhi's was not considered a state visit. "It could have belonged to any other industrialist."

Gandhi's use of the plane illustrates a pair of entanglements lying at the center of Indian politics.

The first is between Gandhi's official role as a political leader, not an official, on the one hand; and the semi-official nature of her work. Though she holds no official position in the government besides member of Parliament, she is widely seen in India as the power behind the throne.

On her four-day visit to Russia, which officials called "private," she was nevertheless accompanied by a most official escort: India's foreign minister, K. Natwar Singh. But Singh did not fly with Gandhi, the official said, electing instead to fly a commercial Aeroflot flight the same day.

The second entanglement is over the government's self-proclaimed neutrality in the Reliance affair, on the one hand; and the difficulties political figures have in separating themselves entirely from a company so vast and pervasive that it pays 10 percent of India's indirect taxes - the taxes paid on goods and services.

The disclosure could empower anti-Reliance factions within the fractious governing coalition and could yield rich fodder for the opposition Bharatiya Janata Party, a Hindu-nationalist party. A spokesman for the party declined to comment on the matter until making his own investigation of the incident.

It was not immediately clear on Tuesday which brother, if either, owned the plane, or whether instead it belonged to the company generally.

To date, the Congress has jealously guarded its neutrality between Mukesh and Anil, with senior government officials reportedly meeting both brothers from time to time, always encouraging them to settle amicably.

Their careful posture stems from the reality that official findings in the investigations could tip how the group is split.

Newspapers here are routinely filled with salacious charges, apparently lobbed by one brother's henchmen against the other, aimed at sparking official inquiries. In this climate, furtive hotel-room or residence meetings between either brother and top government officials, from the finance minister to Gandhi, produce front-page news in India.

For that reason, Gandhi's use of the plane creates a forceful symbolism of the impossibility of separating business from politics - at least in drawing watertight boundaries between India's biggest business house and its most powerful woman, the Italian-born widow of Rajiv Gandhi, a former Indian prime minister, who is widely perceived in India as the power behind the throne.

When Congress won federal elections in 2004, Gandhi declined to be prime minister, passing on the post to Manmohan Singh, a technocrat said to be content leaving the politicking to her.

The importance of the Reliance Group to the Indian economy is hard to overstate. According to figures available on the group's Web site, its $23 billion in sales are the equivalent of 3.5 percent of India's economic activity. It accounts for a vast chunk of the Bombay Stock Exchange's benchmark Sendex index, and it pays 10 percent of India's indirect taxes.

But, increasingly, Reliance's importance to the government is rivaled by the government's importance to Reliance.

Through investigations into allegations ranging from corporate malfeasance to hiring hit men and tapping phone lines, New Delhi is playing a critical role in resolving a larger-than-life dispute between two demi-gods of corporate India.

The dispute originated in the death in 2002 of Reliance's founder, Dhirubhai Ambani, an entrepreneur who built the business from scratch and then, on his death, left no will specifying how it was to run or divided.

Beginning last year, that absence of direction has resulted in a complex battle for ownership of the various companies belonging to the Reliance Group. That battle, which attracted India's leading luminaries from government and banking to serve as peacemakers and mediators, is shrouded in secrecy. Analysts say much of the group's ownership is organized through investment companies whose activities are difficult, if not impossible, to trace.
