RULES AND REGULATIONS OF THE OLYMPIA YACHT CLUB 

Revised 1.1.2020

The following rules shall not be considered as part of the Constitution and Bylaws of the Olympia Yacht Club, but are hereby duly adopted as rules and regulations subject to amendment or repeal only in accordance with Article 9 of the Bylaws.

Rule 1: Reciprocal Moorage: (a) Members of recognized reciprocal yacht clubs will be allowed 48 hours

(2 days) free moorage and use of one power outlet on the OYC visitor floats. After 48 hours, they will pay $0.50 per foot per day for a maximum of five days total moorage in any 30 day period (2 days free & 3 days paid). Any extension beyond five must be approved by the Moorage Master or Main Station Chair.

(b) Special events for visiting yacht clubs are approved by the Commodore and may be granted extended reciprocal privileges (coordinated with Moorage Master).

Rule 2: A completed/signed OYC Moorage Agreement must be filed with Moorage Master prior to berth assignment/occupation. All boats are moored at owner's risk. The Club shall not in any way be responsible for loss

sustained by theft, stress of weather, fire, collision, or careless handling of

boats by other parties, whether said parties are members of the Club or not. Rule 3: Club members are advised to respect the rights of other boat owners by:

(a) Keeping off other people's boats. (b) Staying out of other people's boathouses. (c) Furnishing ample strength mooring lines, so arranged that there be no danger of coming in contact with another boat during the member's absence. (d) Operating their vessels in a safe and courteous manner. (e) Members will report to the Caretaker or Main Station Chair any irregular moorage or hazardous conditions on Club premises. (f) 10:00 PM to 7:00 AM is considered quiet time (no loud or disturbing noises).

Rule 4: The Club may refuse mooring to, and order taken from the premises any boat or boathouse that is maintained in a condition of dilapidation and neglect, so that it becomes unsightly, a nuisance, and a hazard to the Club property, and/or other member's property.

(a) Non Commercial Use: Olympia Yacht Club is not a commercial marine facility. Specifically prohibited from operating from within the confines of Olympia Yacht Club are commercial or business concessions, (which includes but is not limited to; boat and equipment sales, fueling, repair, maintenance, brokerage, charter, fishing or commission activities). Brokers, sales, maintenance or repair persons may conduct their sales or work activities pertaining to a member's boat or boathouse by gaining proper access to Club facilities, through the member in accordance with established OYC procedures as set forth in Rules and Regulations.

(b) Registration: any boat kept within the Olympia Yacht Club facility will comply with current city, state and federal registration laws. Any boat that is registered for other than pleasure will not be used or boarded for any purpose other than pleasure within the confines of Olympia Yacht Club.

Rule 5: Penalties for noncompliance with "Bylaws, Rules, Regulations and Agreements "of OYC: (a) Any member found in violation of adopted OYC Bylaws, Rules, Regulations and/or Agreements (moorage or otherwise) shall be subject to actions provided for in Article 3, Section 6 of the Constitution and Bylaws of the Olympia Yacht Club.

(b) OYC is entitled to reimbursement for the costs it incurs to enforce compliance with OYC Bylaws, Rules, Regulations and Agreements with its members. Members who fail to comply with OYC Bylaws, Rules, Regulations and Agreements will be billed for, and will be responsible for the payment of actual costs incurred by OYC to enforce compliance, including the payment of OYC's attorney's fees and court cost.

Rule 6: Any boat leaving or approaching its mooring, or Club property, must observe a maximum speed of 5 knots and leave no wake. OYC members will abide by all boating laws and will not operate their vessel in a reckless manner. The owner of the vessel will be held responsible for any damage created by the vessel’s wake.

Rule 7: The Club has placed fire extinguishers in convenient places. The members should familiarize themselves with the location of the fire extinguishers and fire alarm system.

Rule 8: The Club docks may be used by members while making repairs or alterations to their boats, but all litter and rubbish must be cleaned away before leaving the docks. Members using the Club workshop must clean up any litter made by them. Any member wishing to use the grids shall ask the Caretaker for an assignment date and read, complete, and sign the approved grid registration form. If for any reason the member is unable to use the date given, adequate notice of cancellation should be given the Caretaker, so that the specified date can be reassigned. Any member found in violation of the signed grid agreement shall be subject to action as specified in Article 3, Section 7 of the OYC Bylaws.

Rule 9: (a) Each boat slip or boat house is entitled to one, and only one, 120- volt, 30-amp GFCI protected connection to the OYC Marina electrical system. For safety purposes, the pedestal electrical connection may not be locked. (b) Before any connection in excess of the 120-volt, 30-amp service or any non-standard connection is installed to the electrical system, it must be approved by the Board of Trustees.

(c) The Board of Trustees may grant a limited number of exceptions based upon the capacity of the Marina electrical infrastructure. A member may request an exception in writing. Each exception must be reapproved annually. An exception does not transfer with the sale of the boat or boathouse. Any violation of the provisions of this rule will result in the disconnection from the OYC electrical system, after proper notice.

Rule 10: No boathouses shall contain showers, sinks, laundry or other equipment that permits gray water to drain into the Sound.

Rule 11: Storage of motor fuel or the fueling of boats is prohibited (other than outboard motors or space heaters) in compliance with fire codes.

Rule 12: The use of electrical fence units is not permitted. Rule 13: No member or guest shall throw or discharge, pump or deposit from

any boat or float refuse, oil, antifreeze or flammable liquid into the water. Individual members are solely responsible for penalties, fines and legal actions resulting from violations of this rule.

Rule 14: Slips and Boathouses

(a)The Board of Trustees and/or the Moorage Master has the right to change the slip assignment of any boat or boathouse moored at the Club docks at any time they deem necessary for the best interest of the Club. (b)Any member making a modification to the exterior of the boathouse, or proposing to build a new boathouse, or to rebuild an existing boathouse will be required to secure an OYC “BOATHOUSE BUILDING, REMODELING, RELOCATION PERMIT". This permit, to be valid, must be signed by the Moorage Master and the Main Station Chair. The OYC permit will be valid for a period of six months from the date of approval.

(c.) Members wishing to lease their boathouse/berth shall notify the Moorage Master in writing prior to occupancy by the lessee. Said leases are to Club members only. Upon approval by the Moorage Master, the lessee may occupy the boathouse/berth for a period of up to six months from the date of approval. Any extensions beyond a given six-month period must be approved by the Board of Trustees.

Rule 15: Any vessel (including dinghies) that extends beyond the finger pier or boathouse must be approved by the Moorage Master in writing.

Rule 16: (a) Without exception, the sale of a boat, or boathouse (except dinghies) moored within the Olympia Yacht Club facilities will be reported to the Moorage Master in writing within five (5) days of sale. Any nonmember purchasing a boat or boathouse as described above and desiring the vessel’s berth must apply for membership and be approved as an active member before taking possession of the boathouse or berth. The sale of a boathouse to a nonmember shall be contingent upon the buyer becoming an active member. (b) Should the sale of a boat be completed prior to active membership approval and the new owner plans to use the boat, the boat must be moved off Club premises until such time the applicant becomes an active member. Upon approval of active membership, the berth/boathouse may be utilized. All boathouses and berths must be returned to 120-volt, 30-amp, GFCI power prior to sale. Noncompliance is grounds for termination of moorage rights for the seller and buyer. Rule 17: Privileges of the Club are extended to all members of a family having membership. This does not include members of a family maintaining a separate household or over age 21. Junior Members are governed by these rules.

Rule 18: The Club Burgee will be flown at all times within the confines of any Olympia Yacht Club facility or reciprocal club facility. Any commercial venture such as charter will not display the Club Burgee or be entitled to membership privileges such as reciprocal moorage unless the Club member is actually on board.

Rule 19: Any member (except juniors) may obtain use of the Clubhouse for private parties by filing a "Clubhouse Use" application, receiving approval, and the payment of current rental fees. Approval is given by the Club House Chair.

Rule 20: All boathouses shall conform to all city, county, and state building and electrical codes and must be metal-covered. All replacements of covering or siding of boathouses shall be of like material. An uncovered window shall be inserted at the float end of each boathouse so as to make visible the contents therein to the Caretaker upon inspection.

Rule 21: Members wishing to live aboard vessels must first receive written approval from the Board of Trustees. A completed/signed OYC Liveaboard Agreement must be on file with the Treasurer prior to living aboard. In addition, liveaboards must also file an OYC Moorage Agreement in accordance with Rule 2. Thirteen liveaboards is the maximum authorized. As used in these rules, a "liveaboard" is a member that lives aboard his or her vessel moored at the OYC as his or her primary residence for more than 20 days in a month.

Rule 22: Vehicle parking at Olympia Yacht Club: (a) The following is the OYC parking policy for members, non-members, and vendors. Parking privileges are intended for members who are attending events and/or while on their boats cruising or liveaboards. The OYC lot should NOT be used for general or prolonged vehicle storage. 1. Trailers and motor homes are not to utilize the parking lot, except for loading and unloading purposes. OYC owned and Jr. Sailor’s trailers are exempt. 2. Members may not have more than two (2) vehicles, including guests, per family in the parking lot at one time. 3. All member vehicles must display an OYC parking sticker adhered on the front window only of the vehicle CLEARLY VISIBLE in all light conditions. Additional parking stickers may be purchased from the Caretaker for $1.50. Parking stickers may NOT be purchased for or given to anyone other than a household family member.

4. ALL vehicles without Club window decal displayed shall be registered with the Caretaker each day. On weekends (May through September), National Holidays, and meeting nights, members without a window decal, guests, and nonmembers shall park off premises. Except for these times or when signage is displayed disallowing guest parking, such parking is permitted from 6am to 5 pm.

5. All parked vehicles must have current State license/registration. 6. Parking is permitted only in designated areas. Fire lanes must be kept clear and Bridge/Employee spaces are reserved at all times. Motorcycles

shall be parked in areas designated for their use, if so marked. 7. If a vehicle is parked in the OYC lot without a CLEARLY VISIBLE sticker, AND is not properly registered, OR in violation of this policy, such vehicle will be towed, without warning, at the owner’s expense. The

current cost for this is about $400. (b) Parking policy for vendors: Vendors who have met the qualifications to

work unescorted at the OYC facility, e.g. have valid access cards, are entitled to park a single vehicle at the Mainstation facility parking lot subject to the following conditions: Note: Non-registered vendors hired by members may park in the OYC lot subject to the vendor parking restrictions and daily registrations (see 1-7 above). HOWEVER, the hiring member MUST BE PRESENT during all times such vendors are working in the facility.

1. The vehicle may occupy no more than a single parking space, e.g. no oversized vehicles are permitted. 2. Parking will be permitted between 6am and 5pm; no overnight parking. 3. The lot located behind Thriftway or the south row parking spaces are to be

used by vendors until/unless all such spaces are occupied. 4. Vendors may not park at the Main Station facility; 1) on national holidays; 2) on weekends from May through September; and 3) if a sign is posted declaring no guest parking on that day. 5. A valid OYC (vendor) parking sticker must be clearly displayed on the exterior of the vendor’s vehicle. 6. Vendor agrees to waive any liability on behalf of OYC for damage to vendor’s vehicle. 7. Any exceptions to the above must be requested of the Mainstation chair in writing and approved. 8. Failure to comply with the above may result in the vehicle being towed at the expense of the vendor and suspension of parking and/or vendor access privileges. Rule 23: Complaints of any nature shall be taken before the Board of Trustees at their regular meeting times. The Board shall give such complaint due consideration and render a decision which, in its considered judgment, shall be in accordance with Club Bylaws, Rules, Regulations and Agreements. Rule 24: Members shall not loan card-keys to nonmembers. Nonmembers

requiring use of a card-key, such as workmen, must have the member obtain a card-key through the Caretaker according to Main Station policies. Strangers who are found on Club property shall be asked for identification and their purpose for being on Club property (guests are not to wander around dock, other boathouses, board boats). The Caretaker has the authority to refuse access to Club property to any nonmember.

Rule 25: A maximum of two card-keys will be issued to each member. Any card broken or damaged may be returned to the Caretaker for replacement at no charge. To replace a LOST card-key, a personal or written request is required to the Caretaker and member’s account will be charged $5.00.

Rule 26: Standard practice in the selection of a contractor by the Board of Trustees will be to develop specifications for bidding and to seek at least three bids for any project between $5,000 and $10,000. Exceptions to standard practice must be approved by the Board of Trustees.

Rule 27: Members’ use of OYC reciprocal docks: Members of OYC are allowed a maximum of 24 hours’ moorage at the visitors’ float in any 30 day period. Any extension of this limit must be approved in advance by the Moorage Master or Main Station Chair, and will be charged at the rate of $0.50 per foot per day.

There shall be no modifications by members to OYC docks (to include attaching additional floating structures to the docks), electrical systems (to include placing locks on power pedestals), water systems, or floats. Any modifications discovered shall be corrected at the direction of the Main Station

Chair at the member’s expense and may be taken before the Board of Trustees for appropriate corrective/disciplinary action. Exceptions to this rule may be approved by the Board on a case-by-case basis. Rule 29: Any OYC member who moors a boat permanently or temporarily, in

an OYC facility must meet the insurance liability requirements of Rule 11, (of the OYC Moorage Agreement Rules and Regulations). Any Member who uses a boat in an OYC sponsored activity must also meet the insurance liability requirements of the Moorage Agreement Rule 11.

Rule 30: Initiation fee shall be as follows: (a) Active Member: $3,000.00 plus State and Federal taxes, if any. (b) Associate Member: $3,000.00 plus State and Federal Taxes, if any. (c) Junior Member: $50.00 plus State and Federal taxes, if any. Except that

this requirement shall be waived for applicants for Junior Membership who are dependents of any Active Member.

BEACH RULES

  • Beach Use -The area to the North of the Clubhouse porch shall be reserved for swimming and sunning, etc. Beach chairs are for members and their guests and may not be used in the water or for boat repairs.
  • Boat Access to Swim Area – Boats entering or leaving the swim area shall do so slowly and carefully near the center red/green channel buoy. Anchoring is allowed only for loading and unloading near the boat ramp.
  • Boat Use Of Beach – The area from the Clubhouse porch South to the boat ramp shall be for day use only, except during regattas.

BOAT RAMP & DRY STORAGE

Dry storage and the boat ramp, as well as the mooring area, are provided by the Club to facilitate increased boating activities. Neither dry storage nor the mooring area is intended to provide long term storage of unused vessels.

  • The boat ramp is restricted for the use of Club members. Use of the ramp is included with the mooring or dry storage agreement. Members who have not executed an agreement will be charge $5.00 for the use of the ramp.
  • Use of the boat ramp is normally restricted to daylight hours. The ramp will be chain and locked when not in use and during the hours of darkness. If a member needs to use the dock after hours, the Manager or the Fleet Captain must grant permission in advance.
  • Only boats of members with a completed dry storage agreement and an assigned space shall be parked behind the club. Boats left without permission will be charged double the normal rate, not to exceed $50 per day.
  • Boats on trailers shall not exceed a maximum length of twenty-five (25) feet; trailers shall be appropriately sized for that limitation.
  • All boats stored on Club property shall be kept neat and tidy, with all gear properly stowed. No additional locker, awning or boat gear is permitted.
  • Given the very limited space on Club grounds, members with Dry Storage Agreement may be asked to remove a stored boat for special events (such as major regattas and tournaments), or for work to be performed on the Club property, with a minimum of ten (10) days advance notice. Failure to comply with the notice to remove may result in the boat and/or trailer being removed from Club property. All cost of removal and/or offsite storage shall be the responsibility of the member.
  • The Club may request members to remove any boat not stored in accordance with these Boat Ramp and Dry Storage Rules, the Dry Storage Agreement, or if boat appears unused for ninety (90) days or more, with (10) days advance notice. Failure to comply with the notice to remove may result in the boat and/or trailer being removed from the Club property. All costs of removal and/or offsite storage shall be the responsibility of the member.

CLUB HOUSE RULES

Club House Rules

  • The Clubhouse will normally be open every day from 0800 hours to 1900 hours. Any change will be posted on the Club Bulletin Board. 
  • The bar will be open from 1100 hours to 1900 hours Monday-Friday. On Friday, hours will be extended to include Happy Hour. 
  • Club members are not permitted to bring or consume their own food or beverages on the Club premises when the kitchen is opened; or to bring and consume their own beverages during the hours when the bar is open.  
  • Members may be asked to show proof of membership when entering Club premises.  
  • Members shall be responsible for the conduct of their family or guests and shall be responsible for any damage or loss to Club property caused by a family member or guest and shall be liable for the amount of any such loss or damage. 
  • No article of Club property shall be removed from Club premises without the prior approval of the House Committee Chairman or Club Manager. The member receiving such approval must sign out the property and shall be fully responsible for its return.  
  • The House Committee Chairman shall be responsible for the furnishing and decoration of the Clubhouse and no change shall be made without his/her approval.  
  • Dressing Room showers are not to be used for storage of personal items.
  • The Club cannot be responsible for articles of value left in the Clubhouse or elsewhere on the premises. Personal articles left on the premises will be picked up, held for thirty days, and then disposed of without notice.  
  • Use of the dock or beach is at the member’s own risk.  
  • Food and beverage prices will be set by the Club Manager with the approval of the House Committee Chairman.  
  • No Club member or guest shall stay on the Club premises overnight.  
  • Members may reserve the Clubhouse for private or group parties by applying to the House Committee Chairman or Club Manager. A fee will be charged.  
  • Outside groups, with sponsorship of a Club member, may contract to use the Club facilities for special events by applying to the House Committee Chairman or Club Manager who will determine the charges and conditions of usage.    
  • Complaints are to be directed to the Club Manager. If not resolved, they shall be directed to the House Committee Chairman or Commodore.
  • Flag Officers, Governors, Committee Chairmen and the Club Manager are obligated to inform any member of a violation of the rules affecting that member, the member’s family or guests.  
  • Littering is forbidden. All trash must be placed in the dumpster. Trash or garbage brought ashore from boats shall be in appropriate containers and placed in the dumpster, not in the trash cans around the Clubhouse.  
  • Children under ten years of age must not be left unattended at the Club at any time. A parent or responsible adult member or guest must be in control of all such children, especially doing Club functions. 
  • Pets are not permitted on the Club premises except in transit to or from a boat. They must be on a leash.  
  • Alcoholic beverages will not be served to anyone less than eighteen years of age. Adults shall not do anything to circumvent this rule. The Club Manager may request proof of age if he/she deems it necessary. No one under the age of eighteen will be allowed in the bar. Juniors bringing alcoholic beverages to the Club will be suspended in accordance with the By-Laws.
  • At the discretion of Flag Officers, Board Members, House Committee Chairperson and Manager on duty, individuals not conducting themselves appropriately are subject to immediate expulsion from the Club premises and further disciplinary actions including, a letter of reprimand, suspension, and permanent expulsion from the yacht Club.
  • For the safety of the members, swimming must be confined to the area within the float lines. No swimming off the dock.  
  • No spinnaker flying or water skiing within the mooring area or Cowpet Bay.
  • Members leaving their cars on the Club Premises overnight or longer must park in the lot adjacent to the tennis courts.
  • All members dinghy’s, trailers, stored boats, and personal automobiles shall display a Yacht Club decal.  Members dinghy’s, trailers, stored boats, and automobiles shall display the Club decal in a prominent, easy to view area, i.e. dinghy’s inside on transom, trailers tongue, auto’s on the right rear bumper. 

Club House Rules (2006)

  • The STYC dock and launch are for the use of Club members who have a mooring agreement; other Club members may use the dock for short periods with the Club Manager’s permission.
  • No rafting of boats is allowed at the dock without the permission of the boat owners(s) or the Club Manager.
  • The South side of the dock is reserved for members’ boats for a period less than thirty (30) minutes. On weekdays this time period may be extended with the Club Manager’s permission.
  • The North side of the dock is for members who require a stay of 24 hours or less.
  • The “T-Head” is for boats requiring a stay of up to three days.
  • A Dock Permit must be completed and approved by the Club Manager for all dock use over thirty minutes.
  • Visiting yachtsmen with reciprocal club privileges may, with the Club Manager’s permission, use the end of the “T -Head” for a fee of $10.00 per day.
  • The north side of dock shoreward of the white stripe is reserved for dinghies and tenders 13 feet and under. Outboards must be left down.
  • The dinghy dock is not meant as a storage dock. Dinghies left over 72 hours will be moved to a mooring.
  • All visitors using the dinghy dock must check in with the Club Manager.
  • Boats and dinghies parked at the dock without the Club Manager’s per­mission, or in violation of these rules, may be towed to a mooring, charged a fine of $25 and lose dock privileges.
  • The STYC shall not be held liable for any loss, damage, or expense Res­ulting from moving a boat or dinghy that is in violation of these dock rules.

MOORING RULES

Mooring Rules and Agreement

The Cowpet Bay mooring field constitutes one of the St. Thomas Yacht Club’s major assets. The purpose of the these Mooring Rules is to manage this asset for the benefit of the Members generally, to encourage Members to own boats and get involved in sailing and power boating, and to fairly and equitably allocate the limited number of moorings among our growing membership.  The General Rules cover the assignment and transfer of moorings among Members while reserving the final decision to the Board to ensure mooring privileges are not abused.  The Operational Rules set forth the rules mooring holders must follow.

General Rules

1. Mooring privileges are available to a Charter and Regular Members in good standing.  A qualifying individual Member who owns a vessel shall complete an application.  All Members who own a vessel together shall jointly complete one application. Once completed, the application is submitted to the Manager accompanied by a $500 deposit along with a valid boat registration for each mooring. The application will list the name of the vessel, its length, and whether it is sail or motor.  Each approved applicant will be required to provide a valid boat registration annually to the manger.

2. Each owner of an interest in a vessel applying for a Club mooring must be a Charter or Regular Member, shall execute a Mooring Agreement for that vessel, and shall provide a copy of the U.S. Virgin Islands Certificate of Number (registration) for the vessel and evidence of the percentage of his/her ownership interest. Such evidence may be pro­vided by Coast Guard documentation, a copy of a partnership agreement, or a notarized document signed by all showing all owners and their percentage interests. The $500 deposit may be posted by one of the vessel owners or split proportionally to their ownership interests in the vessel.

3. The Manager shall maintain a current waiting list of all Members in the order that their applications and deposits are received, noting the vessel’s length and whether sail or motor, and shall keep a copy posted on the bulletin board in the lobby of the clubhouse.  The Fleet Captain shall assign the Member(s) at the top of the list to the next available mooring that is suited for that vessel and the Manager shall notify the Member(s) that a mooring is available.  Billing for the mooring will begin from that date.  The Member(s) shall have 90 days there­after to place a vessel on the mooring, failing which the Fleet Captain shall re­assign the mooring to the next Member(s) in line whose vessel is suited to that mooring.  The defaulting Member(s) shall pay the initial 90 day- mooring fee, be refunded the $500 deposit, and may submit a new application with deposit.

4. Upon the sale or transfer of a vessel solely owned by a Member who has executed a Mooring Agreement, that Member shall have 90 days from the date of the sale to acquire another vessel, substitute the name and length of that new vessel on his/her Mooring Agreement, and place the replacement vessel on the mooring.  If any ownership interest in a vessel already assigned to a mooring changes, the owners shall immediately complete and file a new Mooring Agreement with the evidence of owner attached as required by these Rules.  The previous Mooring Agreement including the Member whose ownership interest is replaced shall be canceled. The Manager shall provide the Board each month with a list of changes in vessel ownership and mooring assignments.

5. Moorings designated as IC-24 Nos. 1 through 12 are assigned to the IC-24 Fleet. To keep this privilege, an IC-24 assigned to one of the IC-24 moorings must be campaigned actively.

6. Any indebtedness to the Club outstanding for 60 days or more shall be subject to revoked Club privileges.

7 . This Mooring Agreement may be terminated at the sole discretion of STYC if the mooring is unused for six months (180 days) or more, with (10) days advance notice.

8 . All boats moored in the mooring field must be kept in a sea worthy condition, as determined at the sole discretion of STYC. Failure to comply with these rules will result in the termination of this Mooring Agreement, with thirty (30) days advance notice.

9.  The STYC, acting through its Flag Officers, Fleet Captain, or Club Manager, in the exercise of its sound discretion, may order the evacuation of the mooring field due to the existence or threat of a tropical storm.  When an evacuation is ordered, the Club Manager or Fleet Captain shall cause a red flag to be flown from the yardarm of the mast over the Clubhouse.  This red flag is the signal that every vessel must be removed from the dock, all moorings and the STYC mooring field in Cowpet Bay.  In addition, as a courtesy, the Club shall attempt to send an email notice to all moorings holders.  The $500 deposit will be for­feited to the Club for any vessel left on the dock or a mooring or in the moor­ing field during such storm, whether or not the vessel does any damage to the dock.  Any forfeited deposit shall be replaced within 30 days. If a vessel left on a mooring in violation of this Rules causes any damage to the dock, mooring field or other Club property, the Member(s) owning the vessel shall promptly pay the full cost of repairing or replacing the damaged property.

10. Under these Rules, a mooring is assigned to a specific Member(s) and a particular vessel. With the permission of the Club Manager or Fleet Captain, the mooring holder(s) temporarily may place a different vessel on the mooring as long as the vessel is of a size and length suitable to the mooring.  Provided it does not interfere with the mooring holder’s use and enjoyment of the moor­ing, the Club Manager or Fleet Captain may allow any Member temporarily to tie a vessel to a temporarily unoccupied mooring.  Similarly, and provided it does not interfere with the mooring holder’s use and enjoyment of the moor­ing, the Club Manager or Fleet Captain may place the vessel of a Member or a visiting yachtsman on a temporarily unoccupied mooring.  The fee for such temporary use of a mooring is $5.00 per day or the minimum mooring fee (whichever is less).  Any funds collected for such temporary usage shall be re­tained by the Club.

11. Members who have executed Mooring Agreements or dry storage agree­ments have the use of the Club launch to transport themselves or their guests between the Club Dock and a vessel in Cowpet Bay that the Member owns or has the right to use, even if the vessel is not on a Club mooring.

12.  A Member who has been assigned a mooring shall be responsible at all times for the care of his/her vessel, the mooring to which the vessel is attached, and any damage the vessel may cause to Club property, other vessels, or per­sons.  Any damages to Club property by an operated vessel shall be the responsibility of the Member owner(s). While away from St. Thomas, such Member must designate a person who will be responsible for the moored vessel and its mooring.  Before leaving island, the Member shall give that person’s name and local telephone number to the Club Manager.  All Members maintaining a vessel in Cowpet Bay are expected to inspect their vessel and mooring lines at least once per month, and in all regards to act in a seamanlike manner in the care and custody of the Member’s vessel.

13.  Although the Club will make periodic inspections of the moorings, and repair those parts below the pennant, the St. Thomas Yacht Club shall not be liable for any loss, damage, or expense resulting from failure of any part of a mooring system.

14.  No Member or his/her guests may live aboard any vessel on a Club moor­ing, at anchor, or at the Club dock. “Living aboard” is defined as spending one or more nights on the vessel. No rafting of vessels on mooring is allowed. Ex­ceptions may be made by the Fleet Captain during Club sponsored regattas.

15.  Flushing toilets or discharging holding tanks is strictly prohibited in Cowpet Bay.

16.  With the Commodore’s approval, the Fleet Captain has the authority to cancel the mooring privileges of any Member for violation of these Mooring Rules, the Dock Rules, the Boat Ramp and Dry Storage Rules, the failure to execute a Mooring Agreement or pay fees imposed by the St. Thomas Yacht Club, subject to review by the Board of Governors.

ALL major boat work (grinding, painting, fiberglass repair, use of any machinery, etc.) will need to be requested and approved by the manager and the Board. These activities will be discouraged on All STYC property.</strong15. <>

17. STYC dock will be used for recreational member only use. All requests for an exception should be presented to the manager for Board approval.

Tennis Rules

  • The Chairman and the Tennis Committee as a whole have au­thority over interpretation and enforcement of court rules as established by the Tennis Committee. If a dispute arises that cannot be resolved by the Tennis Committee the matter will be taken to the Board for final resolution.
  • Tennis Pros shall comply and upheld the Rules on behalf of the STYC Tennis Committee, Board & staff
  • Court hours are from 0700 to 2100 hours. Please deposit your quarters to use the lights. STYC is closed after 1900 and use of courts after that hour is at members own risk.
  • All guests, including houseguests, must be registered at the Clubhouse office with the Club Manager and sign up and pay for court use, clinics, or lessons with Tennis Pro, prior to play.
  • A St. Thomas resident may be invited to play three (3) times a year by any Club member (in accordance with Club by Laws). This means only 3 times / year not 3 invitations by different members.
  • Free clinics organized by the club pro are for members only, unless otherwise specified
  • Clinics, round robins and social events may be organized by The Tennis Committee and Tennis Pro from time to time. With the permission of The Tennis Committee chair these may be open to non-members, however, a fee will be charged and paid to the STYC office.
  • Non-members are allowed to participate in three (3) different Six Week Packaged lessons or clinics within one 12 months cycle.  After the use of the 3 packages, the player must become a member of the STYC to use courts and participate in the tennis program..
  • Club tournaments may be open to non-members.
  • All monies collected including but not limited to entry fees and sponsor fees must be paid directly to the STYC office or STYC event volunteers.  At no time, should any member or non-member pay any fees to the Tennis Pro directly (excluding tips).
  • All rules will be posted on the courts.
  • Proper court attire is expected all the time. This includes shirts and proper shoes.
  • Court 3 is reserved on  Mondays, Wednesdays and Fridays from 4 pm – 6 pm for members only round robin/mixer.
  • Courts 3 is reserved every Sunday morning from 8 am till noon for members only round robin/mixer.
  • Pro must reserve any court for packaged lessons and clinics (with the exception of the times allocated for mixer and free clinic above) and give the Tennis Committee and STYC staff a week’s notice to communicate with members.
  • Pro must reserve any court for a “non programmed” individual tennis lesson like any other member
  • No shows of any tennis program or lesson will forfeit court use after 20 minutes; if member has commenced match he/she shall not surrender court if players and/or Pro show up after  that period of time
  • The Tennis Room is for the use of the Tennis Pro and STYC staff. Please restrain from storing items in this room  (STYC board is working on new storage options and this rule will not be in force until that is available.)

When a sign up system (whether remotely or at the STYC club house is put in place the following will apply:

  • No one except the Pro may sign up for any court use more than a week in advance
  • All players must have completed play on a reserved court before they may reserve another court.
  • All players’ names must be entered when reserving a court including guests/non members.
  • Courts may be reserved for periods not lasting more than one hour and a half and will be forfeited after 10 minutes if at least 2 member players are not present.
  • Please cooperate by leaving the court promptly at the end of your assigned time.
  • Please respect other member’s court and time allotment, restrain from interruptions and court crossing while play is in progress. Wait for end of current game, change over or use the other court entrances.
  • Please address all suggestions, complaints, ideas to the Tennis Pro or a member of the Tennis Committee.

Under this policy club members in good standing will be permitted to use any of the club owned sailing dinghies except the fleet of 420s under agreement with Antilles School, subject to the following terms;

  • Payment of an annual fee of $150, covering a calendar year.
  • Satisfying a competency test for each class of dinghy to be sailed.
  • Checking out with club manager or assistant manager each dinghy and all sailors prior to each usage.
  • Sailing dinghy within sight of the yacht club at all times.
  • Sailing dinghy at all times according to the appropriate rules of good seamanship and making best efforts to avoid collisions or threats to the safety of the sailor(s) in the club dinghy or any other vessel.
  • All sailors must wear coast guard approved life jackets and any other required safety equipment.
  • Returning dinghy and all parts to their assigned location after usage.
  • Checking dinghy and all sailors back in with either club manager or assistant manager.
  • Immediately reporting any damages or equipment failures to the club manager or assistant manager.
  • Failure to adhere to any of the above terms may lead to revocation of the club dinghy usage privileges.

BY-LAWS OF THE VIKING YACHT CLUB TACOMA, WA

ARTICLE I NAME

SECTION I: The name of this Association shall be VIKING YACHT CLUB.

ARTICLE II PURPOSE

SECTION I: The purpose of this club shall be:

1. To promote and encourage a greater interest in boating.

2. To provide instruction for and pursue a policy of safe and sane boat handling.

3. To work for legislation that we deem necessary and helpful to boating and against legislation that is discriminatory, unjust or otherwise detrimental.

4. To conduct cruises, regattas or other allied functions.

5. To develop the friendship, sportsmanship and good fellowship of its members and the public.

6. To affiliate with local and national boating associations.

ARTICLE III

SECTION I: Membership in the club open to boat owners as well as all individuals who are interested in boating.

SECTION II: Membership in the club shall be limited to 100 dues paying memberships.

1. Co-habituating couples shall constitute one (1) dues paying membership, but each shall be eligible to participate in all activities; shall have equal rights and privileges including the right to vote and hold office. Subject to Board approval, two members of the same family may hold elective office concurrently.

2. One (1) dues paying membership shall be available for Associate members who do not own a boat. They shall be eligible to participate in all activities, shall have equal rights and privileges including the right to vote and hold office.

3. The Board shall have the power to change the membership limits should they deem it advisable

SECTION III: Children on reaching age 18 may apply for full membership and then become eligible to all rights and privileges of adult members, including the right to vote. Upon reaching the age of 21, they become eligible to hold the offices of Commodore, Vice Commodore, Rear Commodore, Yeoman or Purser.

SECTION IV: The Membership Chairperson shall encourage solicitation of new members and shall receive and process all prospective membership applications from the member sponsor. The membership chairperson shall contact prospective members to provide a copy of the Club By-Laws and Standing Rules and advise the following:

1. Attendance of two club functions, including at least one meeting, is required prior to being granted membership. The membership chairperson and prospective members shall determine a timeline to complete membership requirements

2. The member sponsor or membership chair will introduce prospective members at each of the two club functions.

3. After first attendance of a meeting or function, the names and background data are to be published in LUR asking for acceptance or objections from general membership. No response will indicate acceptance.

4. Prospective member attends second function.

5. Board acts on membership, and with its recommendation, the prospective member shall be sworn in at the next general membership meeting after paying the required dues and initiation fees. New members may be inducted during the summer season (June, July, and August) at a summer Club function.

6. New members will be provided with membership cards, name tags, burgee, and access to member only sections of the VYC website which includes access to the membership roster, reciprocals, and all club documents and resources.

SECTION V: Any member may resign at any time upon written notice, and surrender of their membership card(s) and VYC Burgee, delivered to the Yeoman. Voluntary resignation shall not entitle a former member to a return of his entrance fee or dues paid.

SECTION VI: Membership in the Club shall be terminated for nonpayment of dues. Such nonpayment shall be defined as 90 days in arrears. Said membership shall revert to and become the property of the Club. Terminated members must return their membership card(s) and VYC Burgee upon notice of termination by the club. Disposition of the unusual cases shall be at the discretion of the Board.

SECTION VII: Membership may also be terminated for cause, after a full hearing before the Board by 2/3 vote of all members of the Board at any regular or special meeting. Terminated members must return their membership card(s) and VYC Burgee upon notice of termination by the club.

SECTION VIII: Any member in good standing called into the active service of the Armed Forces will remain a member in good standing and shall be exempt from all dues and fees until released from active service.

SECTION I: Management of the Club shall be vested in a twelve member Board, elected by the Club in the following manner: a Governing Board to include a Commodore, Vice Commodore, Rear Commodore, Yeoman, and Purser, all to be elected annually. There will be no more than two Trustees-at-Large, to be elected for two year terms, and whose terms shall expire on alternate years and four appointed non-voting chairpersons to include: Membership Chairperson, Parliamentarian, Publicity, and Webmaster. The retiring Commodore shall automatically become a member of the Board as Jr. Past Commodore for the year following term of office.

SECTION II: Five members of the Governing Board shall constitute a quorum.

SECTION III: Regular meetings of the Board shall be held monthly at a time and place designated by the Commodore.

SECTION IV: Special meetings of the Board may be called by the Commodore or by a quorum. Notice of special meetings shall be given in sufficient time to permit the members to be present.

SECTION V: Vacancies in the Board other than the Commodore, Vice Commodore, Rear Commodore, Yeoman and Purser shall be filled in such a manner, as the Board shall determine. Refer to Article V, Section X.

SECTION VI: Any decisions by the Board can be vetoed by a 2/3 vote of the members present at the general meeting.

SECTION VII: Members of the Board are required to be active and do their utmost to attend all General, Special and every Board meeting. Board members missing four regular meetings or four board meetings consecutively without legitimate excuse may be subject to removal from office.

SECTION I: The elected officers of the club shall be a president, who shall be known as the Commodore, vice-president, who shall be known as the Vice-Commodore, second Vice President, who shall be known as the Rear Commodore, Secretary who shall be known as the Yeoman, Treasurer who shall be known as the Purser and two Trustees-at-Large to be elected for two (2) year terms, expiring on alternate years. The Commodore, Vice Commodore and Rear Commodore shall not be eligible to hold the same office more than two terms consecutively.

SECTION II: Method of Annual Election:

1. The Commodore shall appoint a nominating committee of four (4) persons, two (2) of the present board and two (2) club members in good standing. The makeup of that committee will be announced by September 1.

2. The duty of the committee is to prepare a slate of candidates for the elective offices as prescribed within the By-Laws. (Article IV Section I)

3. Each office will be limited to not more than three (3) nominees.

4. The nominating committee recommendations for the officers and board shall be presented to the membership at the September meeting, and names of nominees shall be published in the LUR immediately for the information of all members.

5. Nominations by the membership for officers and board shall be made at the October meeting with election immediately following. If two or more candidates are nominated for one position, names will be in alphabetical order and vote will be by ballot.

6. The Committee shall nominate only those club members who have given their prior approval, who have the skills to carry out the duties of the office, and are willing to accept the responsibilities of the office for which they are being nominated.

7. Absentee ballots will be provided upon personal request to the Yeoman after the close of the September meeting. All absentee ballots must be returned by 8:00 p.m. at the October meeting.

SECTION III: The elected officers will be installed during the Change of Watch ceremony in November. They shall hold office for terms as prescribed by the By-Laws.

SECTION IV: The Commodore shall preside at all General Club and the Board meetings. The Commodore shall be an ex-offico member of all Committees, and shall perform all Commodore duties assigned under these By-Laws. The commodore shall appoint the following positions: Membership, Parliamentarian/By-Laws, Publicity, and Webmaster, a Water Safety Officer, Sunshine Chairperson, an Auditing Committee, the Nominating Committee, the IOBG RBAW representative and any other committee deemed necessary by the Governing Board.

SECTION V: During the absence or temporary incapacity of the Commodore, the Vice Commodore shall fulfill the Commodore’s duties and responsibilities under the same authority vested in the Commodore under these By-Laws. The Vice Commodore is also responsible for presenting the Club budget for the ensuing year.

SECTION VI: The Rear Commodore shall propose and direct all cruising activities.

SECTION VII: The Yeoman shall keep all records and accounts of all meetings of the Club and the Board.

SECTION VIII: The Purser shall be responsible for disbursements of funds for the Club under the direction of the Governing Board. The Purser shall cause an annual audit conducted by the Auditing Committee, and the Committee shall report to the membership at the annual meeting. The Purser shall keep all funds in a bank selected by the Board.

SECTION IX: Vacancies in the office of Commodore, Vice-Commodore, Rear Commodore, Yeoman and Purser (Article IV; Section VI) shall be filled by the membership at any meeting at which a quorum is present. Officers elected to fill vacancies shall serve only until the next regular election.

SECTION X: Any Committee Chairperson may appoint as many members as he or she deems necessary to aid in carrying out the duties of the committee.

1. The Parliamentarian shall be responsible for making sure the meetings of the Board and General Membership are conducted in accordance with Roberts Rules of Order; and for drafting proposed changes to the bylaws of the club as directed by the membership or board. The Board and membership in accordance with the Viking Yacht Club Bylaws shall process the drafted changes in the bylaws.

2. Publicity Chairperson shall be Editor-In-Chief of the Club publication, “LUR” and director of all public relations.

3. Membership shall encourage solicitation of new members and shall receive and process all applications for membership. Communicate with prospective members to fulfill membership requirements and coordinate installation of new members.

4. Webmaster shall be responsible for maintaining and updating the website, and keeping all club documents.

5. Water Safety Officer shall be responsible to inform the membership of ongoing safety regulations and updates from the US Coast Guard and/or Power Squadron and to make reports as necessary.

6. Sunshine Chairperson shall be responsible for sending cards or notes, and if applicable, flowers in certain events, i.e. illness or death. When in doubt contact Commodore and/or Flag Officer.

7. IOBG/RBAW Representative shall be responsible for keeping Club’s Blue Gavel members apprised of ongoing activities, dates and places, and making timely reports and shall attend each RBAW meeting and present report to membership the following month.

SECTION I: The fiscal year of the Club shall commence the first day of January and end on the last day of December of each year.

SECTION II: At the annual meeting in January, the Vice-Commodore shall submit to the members, a proposed budget covering total anticipated income and expenditures for the coming fiscal year. Proposal to revise the budget may be made by any member before the budget is adopted by majority vote. Neither the Board nor any member of the Club shall obligate the Club in excess of the approved budget.

SECTION III: Club funds shall be kept in a bank selected by the Board and in the name of the Club, subject to withdrawal by checks signed in such manner as may be directed by the Board. The Purser is the primary signature on all accounts. The Governing Board, immediately after the Change of Watch, shall appoint Trustee II to a two-year term as an alternate signee on all club accounts.

SECTION IV: An annual audit shall be made of all accounts of the Club. A statement of the financial condition, together with a summary of any other assets of the Club, shall be presented by the Purser at the annual meeting.

ARTICLE VII

SECTION I: Membership fees, dues and the manner of payment shall be determined by the Board and approved by the membership.

SECTION II: Dues shall be payable January 1st of each year.

SECTION III: The Purser shall notify members 30 days in advance of membership renewals via individual emails stating the amount due and date to be received by the purser, notification in the LUR, and a general announcement at the September general meeting.

ARTICLE VIII

SECTION I: The annual meeting of the members of the Club shall be held at the regular January meeting.

SECTION II: Regular meetings of members shall be held on the day of each month as agreed upon by the Board and approved by majority vote of the members. The Yeoman shall give notice of change of venue and time of all regular meetings and the annual meeting to each member and publish such changes in the LUR.

SECTION III: Special meetings of the members may be called by the Commodore or by the Board. Adequate notice must be given to the membership.

SECTION IV: Twenty (20) percent of current membership constitutes a quorum.

SECTION V: Any action taken at a regular or special meeting shall require a majority vote of those present except where otherwise specified.

SECTION VI:

All meetings shall be conducted in accordance with the current edition of “Robert’s Rules of Order.”

VIKING YACHT CLUB STANDING RULES

1) Meetings of the Board shall be held monthly, except for the months of July and August, at a place designated by the Commodore. The meetings in November can be utilized for the Change of Watch and the December meeting can serve as the clubs annual Christmas function.

2) Club meetings are to commence at 1900 hours. A no-host social hour will precede each meeting. Service of cocktails and dinner will be between 1800-1900 hours. 3) At the time of initiation, new members shall be furnished, (cost is included in the initiation fee) a new members packet with a Club burgee, a name tag and the password to the members only section of the Viking Web Site for the bylaws and standing rules. Associated memberships do not include a club burgee. 4) All income generated by the club is to be placed in the General Fund. These funds shall be used for the good of all membership. 5) New members shall be listed in the LUR, the month of their installation. For summer club additions, a shortened LUR that includes new member information will suffice. This is necessary because the LUR is published only 9 months of the year. 6) Any member failing to wear his or her membership nametag during the meeting and entertainment period shall be fined $1.00 The Vice Commodore shall be responsible for the collection of the fines. 7) Proceeds from the “Fun Fines” shall be used for a monthly attendance drawing to be held at the general meeting, by the Vice Commodore. The Vice Commodore will ask a member to pick one name from the member name container. The member must be present to win. If the member is not present, the money in the pot carries over until the next meeting. One dollar in quarters is to be left for the next meeting to make change. 8) A raffle/jackpot drawing will be held each regular meeting for those wishing to participate. The Vice Commodore will sell raffle tickets for $1.00 each. The Vice Commodore will ask a member to pick one ticket from the bucket. Five dollars are to remain in the pot for change for the next meetings raffle. 9) Charter members, Honorary Life Time Members, and Honorary members shall be recognized on the Membership Roster. The names of all other members shall be listed in alphabetical order. 10) Any members holding the title of Honorary Life Time Member shall have their annual dues waived, however, they shall be responsible for the cost of their tickets for the Commodore’s Ball. Amount will be same as dues paying members. 11) The title of Honorary Member shall be given under special circumstances and shall be conferred for the membership year in which it is given. Honorary Members may be guests of Viking Yacht Club for any event deemed appropriate by the membership or the Board. Changes in the privileges of honorary members shall be made at the discretion of the Board and the general membership. 12) Club burgee is to be standardized to 12″ x 18″. Each Club burgee, other than one provided upon installation, will be sold at Club cost. Charter members who want a Charter member star on their burgee must reimburse the Purser for any extra cost. An individual member may not obligate the Club to exchange burgees with another Club. Burgees may only be exchanged after approval of the Board. 13) The following are to be Annual Club functions: Sweetheart Banquet, VYC Boating Family of the Year Cruise, Commodore’s Ball, Change of Watch, Christmas Party and any other functions approved by the board and the membership. 14) Election of the Boating Family of the Year will be held in October. Nominator(s) shall state reasons why nominees should be considered for this honor. If there are two or more nominees, the election shall be by ballot. The person(s) who nominated the winning family shall write a short letter of recognition stating why this family deserves to be elected. A plaque shall be engraved and presented to the Family at a General meeting along with two embroidered patches and the letter of recognition. 15) A special cruise designated, “Boating Family of the Year” (BFOY) cruise, shall be held in honor of the Viking Yacht Club “Boating Family of the Year.” This cruise is to be held during the month of April, or at a time that is suitable for the special family. The cruise captains, nominating members for the “Family of the Year” cruise will arrange to honor this family during the cruise by arranging breakfast for the family and paying for the honorees moorage out of the Cruise Budget. 16) At the January meeting, the Jr. Past Commodore shall distribute ballots for the Viking Yacht Club Sweetheart to male members of the club for voting. Male members only are permitted voting privileges. Absentee ballots will be offered as requested and collected prior to the counting. The sitting Jr. Past Commodore will be responsible for counting the ballots for the next Sweetheart and having the plaque engraved as well as obtaining the Sweetheart patch. The JR Past Commodore shall preside at the ceremony. The past Sweetheart’s mate shall reveal the name of the honoree and crown the new Sweetheart. 17) DUCK AWARD: Any adult member in good standing, who shall unintentionally fall into the water from a boat, dock, wharf or float resulting in a minimum wetting of both feet up to the ankles, shall be eligible for the Club Duck. In case of a questionable circumstance, the Water Safety Officer and his committee shall be the sole and final judges in the matter. 18) STIFF ROPE AWARD: Any adult member in good standing, who shall request and/or accept a tow, or fuel in lieu of a tow, for his boat from any other craft, tug or water craft of any kind, shall be eligible for the Stiff Rope Award, except for a pre-planned tow from permanent moorage to a place of repair work. In case of a questionable circumstance, the Water Safety Officer and his committee shall be the sole and final judges in the matter. 19) PROPELLER AWARD AKA Bent Prop: Any adult member in good standing, who shall have to change the propeller on his boat, inboard or outboard, resulting from hitting anything or running aground shall be eligible for his name appearing on the Propeller club trophy. In case of questionable circumstances, the Water Safety Officer and his committee shall be the sole and final judges in the matter. 20) BOO-BOO AWARD; Any adult member in good standing who shall commit a faux pas relative to boating in any and all circumstances shall be eligible for the Boo-Boo Award. In case of a questionable circumstance the Water Safety Officer and his committee shall be the sole and final judges in the matter. 21) Club policy for withdrawal from or lapse of active membership and subsequent reinstatement to active membership status: A. Lapse of membership due to delinquent dues of less than 90 days: Member pays current year dues and a penalty of $5.00 per month for dues delinquent from January 1 of dues year. Three personal contacts are to be made with the delinquent member by a Club representative. Nonpayment of dues in excess of 90 days can result in a termination of club membership. Per Bylaws Article III Section VI. B. Voluntary withdrawal from active membership (Leave Of Absence) is permitted by a Club member in good standing who intends to reactivate membership in the future. A Club member in good standing may submit a letter to the Board of Trustees requesting transfer of status from active dues paying membership to an inactive non-dues paying status. C. Re-admission to active dues paying membership status of a Club member on approved withdrawal status: A member on approved inactive status may be readmitted to an active membership status at any time by paying the full current year dues. 22) All Officers and Chairpersons shall keep accurate and orderly records of their respective year in office. Where possible, the records maintained and stored by the Commodore, Vice Commodore, and Rear Commodore shall be kept on PC compatible media maintained and stored by the Webmaster. Both such records are to be turned over to the newly elected Officers and appointed Chairpersons during the month of November. 23) The Junior Past Commodore and his or her mate are ex-officio Social Chairpersons after the Change of Watch and shall be responsible for arrangements for the Sweetheart Dinner and the Commodore’s Ball. They may choose committee members as needed. They are also responsible for chairing any other social event planned by membership. 24) The “Change of Watch” Banquet will be the responsibility of the incoming Commodore. He or she shall select the site and installing officer. 25)Awards to be presented at the “Change of Watch” by outgoing Commodore include the Duck Award, Stiff Rope Award, Propeller Award, Boo-Boo Award and any other award deemed necessary in the spirit of friendship and good spirited fun as relates to boating and Club activities. 26) At the “Change of Watch” the Commodore shall present an Award known as the Commodore’s award, to the person he or she believes excelled during the Club year. 27) Commodore’s Budget includes expenses for hosting a party prior to the Commodore’s Ball. 28) An Audit Chairperson shall be appointed by the Commodore no later than the September meeting. This will enable the newly elected Purser to receive audited records prior to the Annual meeting in January so that a report of the audit can be presented to the members. 29) The incoming Commodore shall be responsible for presenting the Past Commodore flag at the “Change of Watch.” 30) The Vice Commodore shall be responsible for having the American flag at each regular meeting. 31) Rear Commodore’s budget includes expenses for major club cruises, i.e. Oyster Feed, Seafood Boil, Steak Fry, Halloween and any other cruise that may require Club expenditures. 32) Cruise schedules shall be printed and presented to the membership as early as possible, but no later than the February meeting. 33) The Standing Rules shall be reviewed periodically by the Trustees and the Parliamentarian. Recommended changes will be approved by the Board, and then presented to the membership for approval. The Standing Rules are to be posted to the website and Club members notified of any revision. 34) Purser shall be responsible for purchasing required flags for elected officers and the Jr. Past Commodore. 35) Excess funds from budgeted activities shall be allocated and approved by the club membership. 36) The Trophy Chairperson shall be in charge of collecting the “Fun Award” trophies and plaques and having them engraved for presentation. Outgoing Commodore shall make the presentations at the “Change of Watch” in November. Nominations and selections of “Fun Awards” recipients shall be made at the October meeting. 37) A tally of election ballots will be available after each yearly election. 38) Persons confirming reservations to any Club function involving a charge, who fail to attend without timely notification, (except for an unexpected last minute emergency) shall be billed for the actual expense incurred. 39) TRUSTEE 1-YEAR and TRUSTEE-2-YEAR: Act to insure that rules of the Club are conducted in accordance with by-laws and Standing Rules and that all business is conducted according to the wishes of the membership. 40) HISTORIAN: Keep records of articles, pictures and any information pertinent to Club activities for posting on the clubs Website.

41) RBAW: Representative or his/her alternate shall attend each RBAW meeting and present report to membership the following month. 42) BLUE GAVEL: Responsible for keeping Club’s Blue Gavel members apprised of ongoing activities, dates and places, and making timely reports. 43) WATER SAFETY: Responsible to inform the membership of ongoing safety hints and to make reports as necessary. 44) SUNSHINE: Responsible for sending cards or notes, and if applicable, flowers in certain events, i.e. illness or death. This information should be shared with Publicity for a potential posting in the LUR. When in doubt contact Commodore.

45) Officers should represent the club at the annual Daffodil Parade and Seattle Opening Day. If officer is unable to attend, a replacement past officer should be found by the board or missing officer.

46) Officers will make every effort to submit a monthly article for the LUR.

47) Current Officers should represent the club at other sister club functions, such as; Commodore Balls, receptions, etc.

Members and Guests

The Clubhouse and grounds are for the benefit and enjoyment by all members. It is the responsibility of each and every member (including their children and guests) to take care of club property, abide by the club rules, and to report any violations to the club manager or officers.

The use of the clubhouse and grounds are restricted to NLYC events for members, their families, and guests. The Yacht Club may not grant permission for use of the premises for private use or events.

NLYC members are welcome to bring extended family, friends, and lake neighbors as guests to most NLYC events including:

- off site events with a fee that typically covers the cost of attending (i.e. Women’s Luncheon, Fish Fry, Golf Outing, Commodores Swing out, Car Rally, Bowling Bash, etc.)

- on lake events that are typically free to attend (i.e. Winter Jamboree, Pontoon Party, Ice Cream Social, Horseshoes and Cards, Youth activities, etc.)

- Night at the Club (but excluding no fee events such as: Club Opener, Happy Hour, and Christmas Party).

Wet clothing, sails, or other equipment are not permitted in the clubhouse unless an emergency exists.

If you are the last member to leave the premises, lock the clubhouse windows, doors, and gate.

And be sure all lights are turned off including garage.

Launch access, Grounds, and Piers:

NLYC members may launch boats in the Spring and removal in the Fall, and during the boating season for regattas and repairs. The launch may NOT be used to launch boats owned by non-members (neighbors, friends, contractors, etc.) or for short term (daily/weekend) use. Members agree to and are responsible for proper use of the NLYC launch including locking the gate upon exit , as well as protection of their password. Misuse of the NLYC launch may result in disabling of their gate lock access.

The NLYC Main (West) gate has an Electronic lock with individual access codes provided upon request only to NLYC members. If you launch your own boat or coordinate with a boat delivery company to meet you at the yacht club to unlock the Main gate, you need to become an “Authorized User” to obtain your own individual access code. If you utilize concierge services from an “Authorized” Commercial Operator for your pier, lifts, boat delivery, etc. you do not need to become an Authorized User. Those “Authorized” Commercial Operators will have their own annual gate key for launch access. See the NorthLakeYC.us website for a current list.

Boats, trailers, and lifts are not to be stored overnight on the grounds.

NLYC has no Lifeguard. NLYC assumes no responsibility for swimmers. Swimming in the boat ramp area is not permitted. Diving, water skiing, or fishing from the piers is prohibited.

No pets on the grounds.

Picnicking on Yacht Club grounds is permitted for members, however take all your trash with you as the Yacht Club does not have garbage pickup and does not use outdoor trash receptacles due to critters.

Firepit use at an NLYC event requires a designated “tender” who is responsible for tending the fire and assuring that it is extinguished at the end of an event.

Members contracting for Shoreline restoration should notify the Rear Commodore prior to work being performed to coordinate scheduling of launch access for equipment and materials, and to communicate the Launch Access Policy with the contractor.

Internet access and usage:

The yacht club has high speed internet access. Members and guests can access the Internet via WiFi in the clubhouse and on the patio. Usage shall be for personal or work-related activities.  Download or upload of obscene, offensive or illegal material is not permitted. All activities conducted while using the NLYC internet must be legal and suitable for all ages.

Members, invited guests, sailing instructors, and sailing school parents who have indoor access to the clubhouse can request the NLYC network password to have full speed and secure access to the Internet.

The bar shall be open only during events approved by the NLYC Board of Directors.

A bartender should be designated and present during family functions.

Report on the office whiteboard any beverages that need to be restocked.

All alcoholic beverages are to be locked in cabinet or locked refrigerators at the end of event.

Game Room (loft):

The game room is for the enjoyment of all members. The game room may be closed during portions of an event by the Event Chairman to facilitate other activities or presentations.

NLYC, NLSS, and privately-owned Boats:

The Yacht Club Judge’s boat and Sailing School coach boats provide safety, rescue, and race committee services in the conduct of club races and sailing instruction. Except in an emergency, these boats are to be operated only by the racing committee, sailing instructors, caretakers, and specifically authorized members.

Sailing school sailboats and privately-owned boats kept at the yacht club are to be used only by the owner or renter of the boat.

General – Event Chairman:

  • A temporary set of Event keys for the gate, building, and bar can be obtained from the Vice Commodore for event setup and access.
  • The Event Chairman is responsible for doors and windows being locked whenever the building is left unattended.
  • The clubhouse is to be left in a neat and tidy condition after every function.
  • If Air Conditioning is to be turned on, turn on both thermostats and set them to the same temperature.
  • If screened windows are to be opened for ventilation, close them before dusk to prevent small insects from being attracted to the indoor lights. And of course, turn off both A/C units when the windows are open.
  • Vacuum carpets and move tables and chairs as needed.
  • Make sure all lights are turned off, and all debris and garbage removed from the building prior to closing.
  • Check to make sure that all faucets are turned off as clubhouse is on a holding tank.
  • Report any damaged or malfunctioning equipment to the Rear Commodore or on the office whiteboard.
  • Event Keys to be returned to Vice Commodore after event.

Any Event Chairman or Club Officer has the authority to evict any person from Club property for conduct detrimental to the Club or its facilities.

Leave it cleaner than you found it.

Wipe all counters, stove, refrigerator, and microwave ovens thoroughly. Sweep kitchen floor.

Wash, dry, and return all dishes to their proper places.

Clean all sinks, making sure no food particles remain.

Take home all used towels and dish towels, and launder them. Return towels as soon as possible.         Do not leave towels hanging to air dry.

TAKE ALL LEFTOVER FOOD HOME. Food left for another event must be labeled. Store unopened food in appropriate containers and cabinets.

Empty all garbage cans (including bar, kitchen, and bathrooms) and replace with new bags.

Contact Quartermaster of any needed supplies such as paper plates, utensils, bathroom tissue, hand towels, cleaning supplies, garbage bags, etc.

These rules are based on the conditional use permit issued by the Town of Merton, July 12, 2005.

Yacht Club of America – Reciprocal Privileges

The Process of Reciprocity:

Yacht Club Reciprocity is defined as “A network of Yacht Clubs in agreement for the mutual exchange of privileges within that specific group of clubs.” The Yachting Club of America has reciprocal privilege agreements with nearly 800 Yacht Clubs throughout the United States.

Although the extent of privileges may vary slightly, generally, an YCA yachtsman can expect to be allowed to use all of the welcoming clubs’ available facilities and services, including short term berthing, meal and bar service, heads and showers, etc.

Typically, a yachtsman can stop at a Yacht Club along his trip, and if the club visited is a YCA member, they are granted access.

All member clubs generally grant access to the bar and restaurant area as well as short term berthing, heads and showers, but depending on the club size and stature, various reciprocal rights are granted depending on the club's policy.

It is always prudent to call ahead to let them know you’re coming as well as to determine what services are available.

2018 RULES AND REGULATIONS

The following Rules and Regulations apply to the operation of Quayside Yacht Club, Inc. (QYC) and the conduct of the owners, renters and guests at QYC. These rules were adopted and approved by the Board of Directors on June 22, 2018, whereby revoking, withdrawing and rescinding any prior Rules and Regulations of the Club.

The Board of Directors reserve the right to amend, change and modify the Rules and Regulations at any time, with or without notice should it be in the best interest of QYC and its owners, renters and guests (herein referred to as member(s)).

Tubing is not allowed coming in or going out of the marina channel inlet or other water areas inside the marina.

No foreign matter, chemical substance or any other foreign liquid shall be dumped, pumped or disposed of in the lake at any time.

Parties and other social gatherings on Club property shall be conducted in a manner which will not infringe upon the rights of other members.

Members shall use discretion with all noise or sound-generating equipment so as to not create a nuisance to the other members.

Docks shall be kept clear of all personal property with the exception of Club approved dock boxes, and if space permits, small umbrella table with chairs.

Fishing, conducted in a safe manner and location that does not impact other members or boat traffic is allowed.

There is no swimming allowed from boats or anywhere within the marina.

Cooking with charcoal or wood is not allowed anywhere on Club property. Cooking is permitted on boats and in the clubhouse using grills with 1lb propane tanks.

Pets shall be managed so that their presence does not infringe on the peaceful enjoyment of the facility by others.

No pets, other than registered, licensed dogs or cats shall be permitted on Club Property.  Pet owners must ensure that all vaccinations, required shots, etc. are current for the pet.

Any dog or cat must be leashed or carried.  Pets may NOT be left unattended.

Pet waste must be promptly disposed of, by the pet owner.

Failure to follow the pet related rules will result in the pet being permanently excluded from the Club.

20 MINUTE PARKING is allowed in front of the clubhouse/restroom building.  THIS IS A DROP OFF ZONE.

Trailers, campers, mobile home or tents are not permitted on Club Property including the parking lot.

All vehicles parked in the parking lot must display a valid club sticker.

VIOLATORS MAY BE TOWED at the owner’s expense.

SLIP/VESSEL SIZE RESTRICTIONS

No boats docked at QYC shall impede the safe navigation of any other boat.  Due to the navigational hazards that may be caused by the size of boats in certain slips, the BOD shall review and approve or deny the placement of any boat that exceeds the maximum CLOA boat length of the slip. See QYC Boat Size Policy for additional information.

In the event the Club Rules and Regulations are violated the Board of Directors is authorized to take action against the offender(s) in accordance with Article X, §10-100 of the By-Laws.

The REMEDY FOR VIOLATION provided for by the Condominium Act, NH RSA Chapter 356-B shall be in full force and effect.

Dear Readers; I am asking for your opinion for a resolution to this club rule that a member brought up to the Bridge. Your assistance to clarify the bylaws as to Membership will be greatly appreciated. It appears from my review of the bylaws that Membership is allocated only to a person with the spouse or partner of a full member effectively inheriting the same rights. So if two people within one membership are no longer in a spousal arrangement, under what conditions could two people chose to continue to retain shared Membership rights? Thank You from new VC

Not any different than any health club, golf club or any other club membership in that their By-laws typically speak to that issue. In the absence of any preexisting policies, it is a matter of opinion and as we all know, opinions vary. Once you enter into the "opinion" domain of making up rules, be prepared to get hit with legal challenges. About the only option you have is to dissolve the membership in question completely as it is based on a partnership which no longer exists but that option too is subject to challenge.

who retains membership Sure, every club wants in the middle of that. Let the parties resolve it as part of their settlement. Until then they are legally members.  

Stretch: Please provide the exact verbiage from the Bylaws or the contract regarding the definition of a full membership. The way you have paraphrased it, it appears a "partner" (i.e. a non-spouse partner, or a former spouse who is now the designated "partner") would have or retain membership rights.  

What is the definition of "spousal arrangement". <g> Maybe you can leave this for the Supreme Court when they determine the definiition of marriage. If you have a "couple" that own a boat together do they have one of these "shared memberships"? If you have been listening to the news lately people are living together without getting married. This is the current trend and they expect that there will be less folks getting married in the future so maybe your bylaws need to be adjusted for the times. I would just take their money! <g>

How about the BOAT has the membership and the owners reap the benefits? Non owners pay a family/crew landed membership fee of a smaller amount. Our club does not define a family beyond cohabitation. Our club events, like parties, allow non members/crew to participate for a guest fee.

We were voted in as a couple. We have but one vote between the two of us. I am not sure what happens at our club when a couple splits when it comes to the membership?

Here's Our Verbage.. (a) Voting Members. Voting Members will be the Applicant and Applicant’s Spouse residing within the same household as the Applicant. In the event there is not a spouse residing with the Applicant, the Applicant may designate another Voting Member who must also reside within the household of the Applicant.  

The spouse or partner effectively inherits the same rights of the full member. If the full member dosen't have a spouse or partner then the rights of the full member remain to be effectively inherited and therfore are not transferable to a NON spouse or partner.  

The Bylaw States 5. The spouse [lawful or common law] of a full member in good standing is entitled to vote and may hold office. Sect A sub c. A member cannot occupy more than one moorage spot Sec 1 sub d. Should a boat be co owned by someone other than a spouse,[lawful or common law] the co-owner will be required to make application for membership as detailed above. above is good standing, moorage surcharge and 20 hrs club time volunteer. There is little in our bylaws to reach a decision, I was hoping someone had to address this already and could offer fair judgement. Thanks for your replies

At Our Club The prmary member would keep the membership in the event of divorce though it can be transfered if part of the decree. We allow a transfer of the primary once between couples so that the spouse can be elected to the board or as a flag officer. When a primary member passes the membership automatically transfers to the surviving spouse. We do have couples who each have their memberships and have each paid an initiation and I presume dues and minimum each month.  

Thanks for some thoughtful advice. It would seem like concensus to let them resolve it. If they cannot resolve it, strike a bylaw commitee and have them report it back to the bridge. As Rick states, the separated member is granted full membership in good standing, upon payment of yearly dues and initiation fee. An expulsion from the club would be a verbally drastic measure, unless it is a technical point of a split, used to allow the ''bridge'' to vote on the ''new'' member, along with the new application and recommendation of 2 members. There are no divorce references in the bylaws. I could let the Past Commodore figure it all out, I think membership is his responsibility, haha. [Just kidding Dave]. Fair Winds

Here is One for You This was before I joined the club so I do not know the couple but this story is told frequently at the bar. A couple had transfered membership from the wife to husband so he could be on the board. They divorced he got the membership. She applied for membership on her own again and was denied. He then quit the club. Kinda like fighting for the custody of the dog, winning and then taking the dog to the pound.  

Our club's by-laws are pretty clear on it: "In the case of a family, both spouses, individually, are entitled to privileges as Active​ Members (with such entitlement surviving any subsequent divorce) ..." So if there's a divorce, their need be no fight over who gets to keep the membership. Of course, depending on the circumstances, this might make for some awkwardness later on! I remember when we joined (and when any couple joins), we took up two membership slots. Essentially each person is treated as an individual for membership and privileges. However, we are expected to only have one car down there at a time, parking is tight.  

From the by-laws you cited, it looks like the "full member" is the member. The spouse gets privileges, but is not a "member." If they divorce, the member is still a member, but the ex-spouse is no longer a "spouse." I would think the ex will then have to apply in his or her own right. In our club, a person (me in our case) is the member. My wife can use all amenities of the club, except she can't vote or go to the annual and semi-annual meetings. If we divorce, she can apply to be a member. (I guess she could do that now if she wanted, but really no need to do so.) My son can now use the club as well, but when he turns 18 or 21, he has to apply to be a member in his own right.

The Cluster Yachting Monaco celebrates the 10th anniversary at the Yacht Club de Monaco

TURIN, Italy, June 18, 2024 (GLOBE NEWSWIRE) — The Cluster Yachting Monaco turns 10. Over 150 people attended the anniversary celebration, before HSH Prince Albert II, president of the Yacht Club de Monaco, who congratulated members for the work they do to promote the Monegasque yachting sector. "This initiative has become a reality. You are ambassadors of the yachting industry in the Principality. We want it to be as sustainable as possible over time but to also have an environmental purpose," said the Sovereign. Turning 10 is also the building of the Yacht Club the Monaco designed by Lord Foster, the centre piece of the remodeled harbor with and eco-responsible approach.

The yachting industry currently represents 411 specialist companies in Monaco, generating 1,429 jobs on land for a turnover topping 567.1 million euros. Since it was set up, the Cluster Yachting Monaco, with its 90 company members, has played a vital role as a unifier and intermediary in this industry. By bringing together the different players from brokers to yacht designers, shipyards to equipment suppliers and many other professions, it has generated a unique synergy to drive innovation and sustainable growth in this largely unknown sector. 

"In ten years we have achieved many milestones, highlighting the strategic aspect of yachting in Monaco’s economy," commented YCM General Secretary Bernard d’Alessandri, Founder & President of the Cluster Yachting Monaco, alongside Vice-Presidents Espen Oeino and Edouard Mousny, Treasurer Laurent Certaldi and the whole industry. Continuing efforts to boost training of talented youngsters, to further improve infrastructure, and promote sustainable practices even more than we do now, are the missions Cluster Yachting Monaco have taken on. All its member companies are keen to build a more sustainable future in accordance with the ambitions of the collective ‘Monaco, Capital of Advanced Yachting’ approach. "Despite the successes, we are aware that there is a long way to go. Many challenges remain if yachting is to become an exemplary sector in terms of economic performance, technological innovation and environmental responsibility," stresses Bernard d’Alessandri. The event was attended by a number of big names in the industry, including Peter Lürssen from the eponymous German shipyard for whom the Cluster "must keep going on this path of excellence and continue to inspire us to build a future for sustainable yachting".

It is with this in mind that so many stakeholders in the sector will be coming to encourage innovation among the younger generation during the 11th Monaco Energy Boat Challenge (1-6 July 2024).
