Boat charter - PPF and Bénéteau acquire Dream Yacht Charter and Navigare Yachting

In the yacht charter sector, which has been severely affected in recent months by travel restrictions, the health crisis has had the direct consequence of bringing about a consolidation that no one would have expected even 18 months ago .

Yesterday evening, the PPF and Bénéteau Groups announced that they had joined forces, through a joint venture owned 59% by PPF and 41% by Bénéteau, to take control of Dream Yacht Charter and Navigare Yachting, two leaders in the sector that have been weakened in recent months by the health crisis.

While everyone knows the Bénéteau Group in the yachting industry, of which it is the world's number two through its 8 international brands, Bénéteau, Jeanneau, Prestige, Lagoon, Excess, Four Winns, Wellcraft, Delphia, PPF is less well known.

PPF presents itself as the leading industrial group in Central Europe, with Czech origins, a turnover of more than 8 billion euros, and is active in the banking, consumer credit, insurance, pharmaceutical, rail and media sectors.

Through the acquisition of Dream Yacht Charter and Navigare Yachting, the two partners create the world's number one yacht charter company, an activity in which the two entities, before covid, had a turnover of 200 million euros, for a fleet of nearly 1,200 boats, positioned in more than 50 marinas!

The great interest of this activity is that it is based on a recurrent economic model - except in exceptional situations such as covid - largely driven by internet applications, with Dream Yacht Charter bringing a nugget, Sam Boat, one of the leaders of its kind, into the takeover basket.

Strongly active in banking, consumer credit and insurance for individuals, PPF is further strengthening its position in this field, which is mainly digitally driven.

For Bénéteau, this arrival in the pleasure boat rental sector is fully in line with the reorganization plan announced on July 9, 2020 by Jérôme De Metz, a plan organized into three distinct parts: a product part with the creation of a House of Brands, an industrial part with the reorganization of factories by type of boat rather than by brand, and finally a "new business" part.

The acquisition of Dream Yacht Charter and Navigare Yachting, whose business model and digital model undoubtedly anticipate new uses for the leading yachting company, is part of this third phase.

It should be noted that PPF and Bénéteau have taken over 87% of the capital of Dream Yacht Charter, with its founder, Loïc Bonnet, remaining a minority shareholder and director of the company, and 50% of Navigare Yachting, with an option on the remaining 50%.

Decoding - The purchase of Dream Yacht Charter by the PPF-Bénéteau tandem is a hard blow for Fountaine-Pajot, the former reference shareholder, which will undoubtedly have to make provision for the loss. Its partner at the time, the investment fund Newstage Capital, is putting 2.6 million euros back into the pot, in order to retain a minority share of 8.7% of the capital. The arrival of two long-term industrialists in its capital is undoubtedly good news for its future development. According to our information, at the end of this acquisition, Dream Yacht Charter will no longer be a distributor (dealer) of Dufour yachts (Fountaine-Pajot Group), but will still be able to rent them within its fleet.

Unforgettable Sailing Adventure

A week's vacation with fantastic swimming spots, great restaurants, and an unbeatable sailing adventure. Our skipper Flu planned a fantastic route for us and gave us the best possible conditions to enjoy the week. I highly recommend him and give him a 10/10 rating. The experience with Navigare Yachting was also completely hassle-free and has been a positive experience from start to finish. I highly recommend it and will definitely come back.

Athens Agios Kosmas Oceanis 51.1

Athens Agios Kosmas Boat: Oceanis 51.1 - Christina Period: 08.06. - 15.06.24 Defects discovered during check in: - Water tank leaking, resulting in constant water in the bilge - Front sinks did not drain - Door handles were missing - Bowsprit severely damaged - Sprayhood zippers defective - Bimini zippers defective, fabric torn - Webasto heater control buttons missing - Truw wind sensor without function - Inner shell had cracks - No marking on the anchor chain - Defective outboard motor (was replaced) - Handle on one steering column broken The check-in took a long time, as the repair of the water tank, the washbasin and the door handles began at around 14:15. The technical staff made every effort to repair the defects (big praise to Costa). In order to repair the defective wind sensor, a roof panel had to be removed and a plug had to be disconnected and reconnected several times until the data was transmitted back to the system. After it was decided that we could set sail with the defects rectified (15.45), the Navigare employee responsible came and had the skipper sign three documents. Only then were the documents taken to Port Police. Supposedly we could set sail at 16.15. The process went on until 18:00. The employee had already received the signatures at 1 p.m., which she did not consider necessary. During the week, further defects were discovered on the yacht: - the yacht did not run straight ahead, the center position on the devices did not match the rudder position which often resulted in the failure of the autopilot - the B&G plotters were constantly overheating and simply switched off several times a day after freezing up - the True Wind transducer kept failing - the water tank kept leaking water, which we had to refill 5 times - An oil-water mixture collected in the engine bilge and it smelled of burnt oil - The freezer drain was defective, about 5 liters of water collected in it - A toilet was leaking, the fastening screws could not be tightened and was therefore unusable - the diesel and water display on the control panel did not show the correct values In general, I ask myself what kind of expectations are placed on a crew that pays almost 5000 euros for a yacht. I'm not talking about the visual or hygienic conditions here. These were catastrophic on this yacht. Lots of dirt, hair, leftover food in the gaps in the floorboards and underneath (we found old shoes, care products etc.). Torn upholstery (foam was visible) with stains. Damaged interior fittings, lockers that don't hold, broken latches in the back box, etc. For me, the safety-relevant things such as the failure of the electronics, the engine leaking oil, the leaking toilet, no markings on the anchor chain, etc. are much more important. The maintenance backlog is manageable, but the service backlog on the technical parts is not. The toilet would also have been noticed at check-in, but the water tank repair prevented us from doing so. You can see that things can be different with charter companies like Pitter. Even the oldest yachts there are in perfect technical condition. In any case, Navigare will no longer be considered for the next booking

WOW! Sailing in Croatia with Navigare Yachting

We had an amazing sailing experience in Croatia with Navigare Yachting! For any Americans thinking about visiting this region, we highly recommend chartering a boat to see the beautiful coastline. We added a captain since no one in our group had the sailing experience, but it was great to have a local skipper to take care of everything. Hvar Island was by far our favorite stop, but our skipper took us to a few exclusive lagoons and swimming spots and always made sure we were having fun and seeing beautiful places. Thanks again, we'll definitely be back for more!

Great experience with Navigare.

I can only talk about my experience in Marsh Harbour in The Bahamas and Navigare were faultless. We had a lovely Lagoon 46 Catamaran. It was well prepared and looked after, both the area and boat briefing were great and informative and the staff at the base were extra friendly and genuinely nice people we had a great holiday!

Horrendous money grabbers

Horrendous money grabbers. Used them in Croatia this year the boat was not as well kept as other Also we tried to change a booking with lots of notice due to family health reasons. The we’re very abrupt and rude and just refused Have always chartered boats twice a year. Not with Navigare anymore Also I bet they reply to this by please contact reservations@navigare. - that is who has been refusing to discuss our problem

Skipper Marko, super capable and great company.

Skipper, Marko Sapunaric took us on a trip from Dubrovnik round Croatian islands. We were a mixed party some wanted wild swimming, some top rate food, some to get drunk in beautiful places and he made sure everyone was happy and everyone's hopes were surpassed. We visited some stunning places, Mali Ston and Polace just two, I fell in love with Croatia. Mainly because our skipper took time to show us amazing places: tell us about the language, the countryside and the people. Every time we stopped, he backed a huge boat into a tiny space and ensured all of us could exit to shore. We encountered some rough seas and they were handled expertly, leaving us cheering on the net as the boat bounced. We all had the most amazing time and were all so sad to go home. We all wanted to become pirates and keep sailing. Thanks Marko for an awesome trip, looking forward to next year!

Very positive bareboat charter experience.

Just returned from a ten day bareboat charter in the BVI. Our experience with the cimpany and it’s staff was great from start to finish. We were provided airport pickup service, and arrived to a warm welcome and a cold beverage. When our expected boat was not available as it required service, we were upgraded to a larger catamaran at no extra charge. The boat was a much better fit for our large crew of 7 and we were very pleased with the upgrade. The boat was spotlessly clean and well stocked with dishes, sheets, towels, snorkel gear and basic cleaning supplies. We got a thorough briefing and even a trial sail with a staff person ( as we were prepared to sail a monohull) to become familiar with the systems of the boat. Navigare was available by phone anytime questions arose and were very customer service oriented. We had a spectacular vacation and would not hesitate to book with Navigare again. Thank you all for a memorable time!!

Just back from a week on a Navigare Lagoon 42

I've just returned from a week in the BVI's on a Navigare Lagoon 42. This was the second time we have chartered through Navigare, and will gladly use them again next time. The whole process was very easy and fast, and we were able to get our boat out on the water with a minimum of delay at the start of the trip. The boat was clean and well equipped, and we the only issue we had was that check valves in the heads often backflowed, which made the bathrooms a bit stinky, but I'm thinking this could be a Lagoon 42 design issue because the holding tank is higher than the head. However, sailing the Lagoon 42 was a real pleasure, and we were very comfortable with 8 people aboard. The checkout process was also fast and easy, and we were off and on our way with a minimum of delay.

Beware contract fine print. Not trustworthy

Beware contract fine print or your 7 day trip will become a six day trip. Our contract said that boat had to be returned on August 23 by 9am on page one and then had a clause in the bottom of page 5 that the boat would have to arrive at the base the day before. This forced us to shorten our trip by one day.

Dear Pedro, thank you for your comment and lifting this issue. We are very sorry for the confusion and understand that you would have preferred staying out on the sea sailing longer. Saturdays are when boats are being turned around for the next charter, which is why the boat needs to be in the Marina by the day before. But you don’t have to take your luggage and leave the boat until 9.00 am on the departure day. We will make sure to make this clearer in our contract, to avoid any disappointments. Got a SY without a main - bad communications from the back office - WITH EDIT

EDIT NOVEMBER 2023 After having written this review, we received a fair refund and were contacted by the global communications team. The office promised to improve their processes for the next time. ORIGINAL REVIEW We spent one week on a Navigare Yacht heading out from the Palma di Mallorca base. Unfortunately, the trip went differently than we thought, since we got the boat LOCO AMOR without a main sail, resulting in very uncomfortable nights. Our original plan was to head to Ibiza for the week and spend our holidays cruising there. When we arrived at the base in Palma, however, we received a boat without a main sail. Even though we found the staff to be very apologizing, they could not provide us with a suitable replacement on the spot, meaning we had to change our plans to not go to Ibiza AND head out with a SY without a furling main sail. This resulted in three days and two nights of constant, disruptive noise as the furler clanged against the mast. The cacophony was audible both on deck and in the cabins, making for very uncomfortable nights. The base provided us with a main sail afterward in a port after two nights and three days. From the outset, we were informed from the technical staff that we could reach out to the Navigare headquarters for compensation or a reduction in price. Unfortunately, it proves exceedingly difficult to establish contact with anyone from the headquarters. No one takes responsibility, and the overall customer service experience from the back office is horrible. The complete lack of communication following such an incident is, in our opinion, unacceptable. I would NOT RECOMMEND booking with them! I, for one, have no intention of doing so in the future.

Unsafe vessels and poor management

My issues with the company/service provided and the boat are the following: 1. The boat was not ready as agreed upon for early "VIP" access to the vessel. When we arrived we were not greeted nor shown our boat by any of the staff. We waited over an hour before we decided to just go and find the vessel ourselves. I had to request for the boat to be re-cleaned. This occurred at 5:00pm. Once cleaned and unpacked we still were not greeted by a staff member to advise us on what to do next. We did not get asked for our paperwork till 6:00pm. We did not get our paper work back and get a handover on the vessel until 9:30pm. Thus we lost a day of travel on the boat which then disorganised our planned itinerary. 2. We were not provided with working Wifi on the boat. I informed the staff and they just told me to try and have an internet box and cord on one of the islands.... This was not acceptable. 3. There was no 24volt power supply on the boat. We were told that none of the electrics worked other than 2x USB ports. 4. The house and motor starter batteries were labelled incorrectly on the boat and the fuel gauge did not read properly on the boat. We finished that trip under the impression we had 70% of fuel left. however when we filled up we were charged 150 Litres... THIS IS VERY DANGEROUS. 5. We advised the staff of our concerns including other less serious issues... however they dis-regarded everything we told them. On top of our experience above, we have not had sufficient customer service from the after sale team. We requested 24 hrs refund for the delay. They have not acknowledged such nor addressed the safety concerns on the vessel.

⚠️ Warning to all boating enthusiasts

⚠️ Warning to all boating enthusiasts: I want to share an extremely disappointing experience with Navigate Yatching . I specifically hired for a special occasion during a week a 51-foot Fountain Pajot (named: No Shoes) in Tortola,. We specifically wanted to sail this model, because we are considering to buy one. However, on the day of our arrival, and after making the full payment, the company switched us without prior notice to a different and cheaper model (BALI 47). We had the option to rent a Bali in St Thomas with other companies, but we wanted the Fountain Pajot, so we traveled to Tortola. What's most infuriating is that there was no previous warning, no refund of the price difference, nor any apologies from the company. I sent a mail to customer care (Sanja Permin) and I am still waiting for response. I spoke with Theresa from Navigare Yachting BVI's Customer service team & Avril/ Patrice, and they just told me "do what you want to do, we can not help you". in what I consider a complete abuse and inability to solve the problem, or minimize their consequences. This lack of professionalism and respect for customers is unacceptable. I want to warn everyone considering using their services: proceed with caution. Not a good experience in Tortola, BVI with Navigare …

We rented a Lagoon 450F with Navigare from Tortola from Dec. 27th to Jan. 7th and here is why I rated it 2*, starting with the most unpleasant : 1. Attempted 'bait and switch'. While the Navigare coordinator had contractually guaranteed to us in writing a 2018 boat named Stella that was not on island when hurricane Irma unfortunately struck, when we arrived we were told without explanation by the local base that our boat was Kajsa, a 2016 boat -with Stella moored next to her- that had been bullied by Irma and that Stella had now been allocated to another group...Needless to say we got a little flustered, managed to raise the coordinator in Serbia after hours and finally got the original cat assigned to us. So no harm done in the end but a lot of stress, aggravation and us having to fight to get what we had already paid for. Not a good start. 2.No sheets on board, discovered once we were gone. OK, granted there's worse but given the amount you pay for this type of holiday, you would expect the base to do a walkaround with a check-list prior to departure to ensure that everything is where it should be. We finally got the sheets 3 days later as we came back to shore to Tortola for this purpose. 3. The skipper -who was otherwise pleasant and helpful- apparently had not been told that we would use the four double cabins and that he would have to sleep in the front, in a smaller cabin without internal access or toilet/shower. We had to explain to him that this was what we had booked and told him he was welcome to use one of our showers and toilets. He reluctantly accepted but it added to the rocky start of our holidays. We understand and sympathize that the BVI suffered a lot of hardships because of Irma and are still struggling, but given that Navigare had already relocated to their new marina for one month when we arrived and that the inconvenience we suffered were of Navigare's own doing rather than a consequence of Irma, we feel that -even though the rest of the trip was great- Navigare's performance with us was sub-par. We rented a yacht in British Virgin Islands and it was a disaster!!…

We rented a yacht in British Virgin Islands through Navigare and although the BVI is lovely, the yacht was terrible and our experience with Navigare was to be blunt appalling. We hired a catamaran with extras including standup paddle boards, snorkelling equipment, pre-paid mobile and wifi. It also had what we assumed were the basics, a first aid kit, aircon, working generator so that we had power and lights. On arrival we had no snorkelling equipment or paddle boards. We later found out that we also had no first aid kit, aircon and no working stove / no way of lighting a stove. Finally we also had no power or wifi. On the first night, we had no working aircon and in 1 room no working fan so no-one got any sleep at all as it was very stuffy. The skipper advised that we would have to return to the marina to get it fixed. So we returned to the marina and waited for a couple of hours while this was fixed before heading out again. Within 30 minutes of leaving the marina the air con was again not working in two bedrooms... but we decided that we did not want to waste any more of that day getting it 'fixed' again and we went on to our mooring for the night and advised base that they could come to us and fix it the next day. The next day we waited for someone from base to come and fix the aircon, but no-one came. Finally we travelled back at the main Island (1.5 hrs) of Tortola parked back in the 'nice anchorage' at the end of the main airport waiting for them to arrive and fix the aircon.... they again spent an hour regassing the aircon, which lasted an hour and then did not work anymore. They did leave us a lighter for the stove though so we could use the stove. The following morning, we headed off and advised base station to bring us a different boat so we could swap as by now none of us had had any sleep due to the heat. We swapped boats (an upgrade apparently) and this boat had a generator which completely crapped itself at 0200 which meant that we didn't only have no aircon, we had no power points, lighting or wifi. The base seemed to think that this was perfectly acceptable. The base manager Crompton was extremely aggressive towards me, and starting yelling and talking over me when I tried to explain that we were ending the charter a day early due to all the faults on the boat and no solution offered by either himself or the skipper of the boat at any time. In fact the base manager at no time contact me and the skipper of the boat would not let me talk to the base station about the issues on the boat. It was all very odd. The issues were: - no first aid kit - no working generator - no air con - no powerpoints - no wifi - no working stove for the first couple of days. In addition to the issues with the yacht Navigare took $400 US from my credit care as a security deposit on the navigation card for the map reader which has not been returned so I have had to lodge a complaint with my credit card company to have this returned. I have also lodged a formal complaint about the yacht, having to finish our cruise a full day early due to major mechanical fault (the completely broken generator) and had no response at all. Not good enough Navigare, I have full audio of Compton's bullying behaviour towards me when we spoke after we returned the yacht and I will release it in full with my blog review of your yacht service shortly.

Launched two decades ago with a single charter location in Greece, Navigare today operates in 9 countries—with more on the way—and it offers sailors a fleet of more than 300 sailboats, including monohulls from builders such as Arcona, Beneteau, Dufour, and Jeanneau, and sailing catamarans from brands that include Lagoon, Bali, Excess, and Fountaine-Pajot. Recently the company has added Aquila power cats to its lineup, and coming next year, it plans to offer all-electric Island Spirit Catamarans for charter. The vast majority of Navigare’s charter yachts are privately owned and managed by the company. Early on, the fleet was made up entirely of monohulls, but today, roughly two-thirds of the boats are catamarans. On the sales side, nearly 90 percent of the vessels Navigare delivers to owners are cats, and the company estimates that eventually multihulls will make up 80 percent of the fleet worldwide.

Coming from Scandinavia, Navigare founder and CEO Jesper Rönngard says that he always thought of the Mediterranean as the warm place for sailors. About 10 years ago, though, the company expanded first to Thailand and then to the BVI. Tortola, he says, is the most popular destination with American sailors. Today, the company does about half its business in the Med, and the remainder elsewhere in the world, including the Virgin Islands, the Seychelles and Sweden. The Bahamas, he notes, is also an extremely popular destination and earns nothing but five-star reviews with charterers. In 2024, the company plans to add St. Maarten and Tahiti to its list of destinations.

All About the Boats

With Navigare, no matter where or what you choose for your charter, the common denominator across the company is the keen attention the staff pays to maintaining the fleet, Rönngard says. 

“We really try to take care of the boats,” Rönngard says. “And by taking care of the boats, we take care of the boat owners and make sure the boat owners are happy. And that way, kind of as a bonus, the charterers are really happy with the boats. That’s been our idea from the get-go. When we started the company, it was always about maintaining the boats, giving them proper service. This way, we knew that we would grow, just by word of mouth.”

That’s not to say that every boat and every vacation is trouble-free—they’re boats, after all. But having the ability to respond quickly with a chase boat to make needed repairs is also something the staff does well, he adds.

Options for Charterers, Choices for Owners

There are a number of ways to charter with Navigare, the most common of which is a bareboat vacation of a week or longer, where you get the boat to use with family and friends as you wish. Other options include skipper and luxury crewed trips, by-the-cabin charters, and flotillas, where a local guide leads a number of boats that share an itinerary that can include both free time and group events. 

Navigare also offers sailing instruction so that guests can learn to skipper their own bareboat yachts. The two-week course is taught from the company’s base in Seget, Croatia, and uses a curriculum developed by the International Yacht Training Organization. It allows students to earn an IYT Bareboat Skipper Certificate. Details can be found at Navigare Yachting .

Yacht sales are another important part of Navigare’s business plan. Its brokerage office is based in St. Petersburg, Florida, and the company offers three programs for buyers, ranging from a fixed monthly income plan to one that gives an owner lots more flexibility in terms of risk and revenue.

THESE TERMS ALSO CONTAIN A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK. By creating a username, a login, clicking submit, using the services of Charter Experts, LLC d/b/a Virgin Island Sailing® (“ Broker ) or by accessing Broker’s website, you agree that you have read, and acknowledge your acceptance of these Terms. The Terms are subject to change at any time without notice at Broker’s sole discretion. Additionally, any transaction for which you have made payment shall be governed by the form of Terms in effect at the time of such payment notwithstanding any subsequent changes hereto.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

  • Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

  • Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
  • Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

  • Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
  • Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
  • Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

  • Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

  • No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

  • Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

  • Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
  • Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.

was supposed to be laid last June and ready for commissioning in late Oct. That didn't happen. Our sales guy from Navigare told us that they were having issues getting a hull date from FP as they were allocating for the New 45.

So...{shrug}...our isn't in production yet, but we are still sailing around on everyone else's!

In our case, as posted above, we were told that our hull was delayed by a year by . Given the Covid situation, it will most probably be two years until our hull hits the fleet, assuming that they move new boats into the fleet as fast as they did before. I'm more of realist. Some might call me a cynic. I think the industry will be slow to start up again and they are not going to need to more boats into the system when charters are not fully utilizing the boats already there. Since the season in the BVI is only 8 months long, I could easily see out hull, originally scheduled to be in the the end of 2019, not in the fleet until 2022. That timing obviously makes a huge difference on the numbers and the attractiveness of an investment.

We are in discussions with Navigare about moving our investment into a different program and boat, but we are getting a lot of push back and not much creativity. I'll keep you informed.

Enjoying my time on the boat. Unexpected but worked out well. Thinking about something bigger... Might sell this one for the bigger dream.

46 was delivered to Navigare in Tortola in December and had a couple charters before I was able to use it in February. were missing and there were several other issues...all reported during the time I used it. After receiving my first quarter statement and making little..and being charged alot - covid hit and I decided to get my boat out as I didn't want to constantly fund Navigare. Moved the boat to Florida and up ...at a big loss with nothing repaired/replaced from Navigare. I remain stunned by the lack of transparency, poor and overall bad approach.

British tech magnate Mike Lynch, 5 others missing after luxury superyacht sinks off Sicily

ROME -- British tech magnate Mike Lynch and five other people were missing after their luxury superyacht sank during a freak storm off Sicily early Monday, Italy's civil protection and authorities said. Lynch's wife and 14 other people survived.

Lynch, who was acquitted in June in a big U.S. fraud trial, was among six people who remain unaccounted for after their chartered sailboat sank off Porticello, near Palermo, sometime after 4 a.m. A tornado over the water known as a waterspout had struck the area overnight, said Salvo Cocina of Sicily's civil protection agency.

One body was recovered, and police divers spent the day trying to reach the hull of the ship, which was resting at a depth of 50 meters (163 feet) off Porticello where it had been anchored, rescue authorities said. They returned to the site after 10 p.m. to see if it would be possible to search through the night, when weather conditions were expected to worsen, said Luca Cari, spokesman of the fire rescue service.

The ship had a crew of 10 people and 12 passengers, the Italian coast guard said. A sudden fierce storm had battered the area overnight, and a waterspout struck precisely where the 56-meter (184-foot) British-flagged Bayesian had been moored.

"They were in the wrong place at the wrong time," said Cocina, noting that another big ship nearby, the Sir Robert Baden Powell, wasn't as badly damaged and helped rescue the 15 survivors - including Lynch's wife, Angela Bacares.

The Bayesian was notable for its single 75-meter (246-feet) mast - one of the world's tallest made of aluminum and which was lit up at night, just hours before it sank. Online charter sites listed it for rent for up to 195,000 euros (about $215,000) a week.

One of the survivors, identified as Charlotte Golunski, said she momentarily lost hold of her 1-year-old daughter Sofia in the water, but then managed to hold her up over the waves until a lifeboat inflated and they were both pulled to safety, Italian news agency ANSA reported. The father, identified by ANSA as James Emslie, also survived, said Cocina.

Karsten Borner, the captain of the Sir Robert Baden Powell, said he had noticed the Bayesian nearby during the storm but after it calmed he saw a red flare and realized the ship had simply disappeared, ANSA and the Giornale di Sicilia newspaper reported. Borner said he and a crew member boarded their tender and found a lifeboat with 15 people, some of them injured, who they then took aboard and alerted the coast guard.

Eight of those rescued were hospitalized while the others were taken to a hotel. One body believed to be the cook was found near the wreck, but six others were unaccounted for and believed inside the hull, said Cari, the fire rescue spokesperson.

The rescue operations, which were visible from shore, involved helicopters and rescue boats from the coast guard, fire rescue and civil protection service.

Fisherman Fabio Cefal ù said he had seen a flare from shore at around 4:30 a.m. and immediately set out to the site but by the time he got there, the Bayesian had already sunk, with only cushions, wood and other items from the superyacht floating in the water.

"But for the rest, we didn't find anyone," he said from the port hours later. He said that he immediately alerted the coast guard and stayed on-site for three hours, but didn't find any survivors. "I think they are inside, all the missing people."

He said he had been up early to check the weather to see if he could go fishing, and surmised that a sudden waterspout had struck the yacht.

"It could be that the mast broke, or the anchor at the prow pulled it, I don't know," he said.

Cocina said the crew and passengers hailed from a variety of countries: In addition to Britain and the United States, passengers and crew were from Antigua, France, Germany, Ireland, Myanmar, the Netherlands, New Zealand and Spain, he said.

The UK Marine Accident Investigation Branch is deploying a team of four inspectors to Italy to conduct a preliminary assessment. The Foreign Commonwealth and Development office said it was "providing consular support to a number of British nationals and their families."

Dutch foreign ministry spokesperson Casper Soetekouw said the lone Dutch citizen on board, a man, had been rescued and was not in life-threatening condition.

Lynch, once hailed as Britain's king of technology, was cleared in June of fraud and conspiracy charges related to Hewlett Packard's $11 billion takeover of his company, Autonomy Corp.

The not guilty verdicts followed an 11-week criminal trial in San Francisco that delved into the history of HP's 2011 acquisition of Autonomy, a business software firm founded by Lynch.

The fraud accusations represented a dramatic turn in the fortunes of an entrepreneur once described as the Bill Gates of Britain - a title he seemed to live up to when he netted an $800 million from the Autonomy sale.

The acquittal vindicated Lynch, who had vehemently denied wrong doing and portrayed HP as a technological train wreck.

"I'm looking forward to returning the UK and getting back to what I love most: my family and innovating in my field," Lynch said in a statement released after the verdict.

The yacht, built in 2008 by the Italian firm Perini Navi, can accommodate 12 passengers in four double cabins, a triple and the master suite, plus crew accommodations, according to Charter World and Yacht Charters.

The vessel, which previously was named Salute when it flew under a Dutch flag, featured a sleek, minimalist interior of light wood with Japanese accents designed by the French designer Remi Tessier, according to descriptions and photos on the charter sites.

UK tech tycoon among six missing after yacht sinks

British tech tycoon Mike Lynch and his 18-year-old daughter are among the six people missing after a luxury yacht sank off the coast of the Italian island of Sicily in the early hours of Monday morning.

The 56m (183ft) vessel was carrying 22 people including British, American and Canadian nationals. Fifteen people were rescued, including a one-year-old British girl, and authorities are continuing their search into the night.

Local media reported the yacht, named Bayesian, capsized at about 05:00 local time after encountering a heavy storm overnight that caused waterspouts, or rotating columns of air, to appear over the sea.

Mr Lynch, known by some as "the British Bill Gates", co-founded software company Autonomy, which was later bought by tech giant Hewlett-Packard for $11bn (£8.6bn).

Witnesses told Italian news agency Ansa that the Bayesian’s anchor was down when the storm struck, causing the mast to break and the ship to lose its balance and sink off the coast of village Porticello, near Sicilian capital Palermo.

A waterspout is similar to a tornado and can form over oceans, seas or large lakes.

Divers have identified a wreckage 50m below the water's surface and are searching for those missing.

The director general of Sicily's civil protection agency, Salvatore Cocina, told the BBC Mr Lynch, his daughter Hannah Lynch and the yacht's chef were among the missing.

He said the search, involving caving and rescue diving teams, would continue overnight.

The body of one man was found outside of the wreckage. His nationality has not been confirmed.

BBC Verify looked at corporate records and found the Bayesian's ownership is tied to Mr Lynch's wife, Angela Bacares.

Sources close to the matter have confirmed to the BBC Ms Bacares has been rescued.

Fifteen people managed to get to safety after the storm hit.

Ansa news agency reported a 35-year-old mother held her one-year-old daughter in her arms in the sea .

The woman, named as locally as Charlotte Golunski, said: "For two seconds I lost the little girl in the sea, then I immediately hugged her again amidst the fury of the waves.

"I held her tightly, close to me, while the sea was stormy. Many were screaming.

"Luckily the lifeboat inflated and 11 of us managed to get on board."

The baby is fine and the mother was treated with stitches, the agency said.

She added she had been on the boat with her husband, who is also safe, and colleagues from a London company.

A doctor based at the Di Cristina Hospital in Palermo, where some of the survivors were taken, said they were "very tired" and "constantly asking about the missing people".

Dr Domenico Cipolla told Reuters news agency: "We have given the survivors this information, but they are talking and crying all the time because they have realised that there is little hope of finding their friends alive."

Survivors said the trip has been organised by Mr Lynch for his work colleagues.

In the initial aftermath, a nearby Dutch-flagged vessel rescued survivors from the waves, tending to them until emergency services arrived.

Captain Karsten Borner said after the storm had passed, the crew noticed that the yacht that had been behind them had disappeared.

"We saw a red flare, so my first mate and I went to the position, and we found this life raft drifting," he told Reuters.

That life raft was carrying 15 survivors, three of whom were "heavily injured", he said.

A local fisherman told Reuters news agency he had seen people being rescued by an inflatable boat dispatched from another yacht.

The captain of a local fishing trawler said he saw debris, including cushions from the deck, floating in the sea.

Footage from the wreckage site showed helicopters circling over several coastguard vessels as divers wearing bright orange descended into the water.

Eight of those rescued are receiving treatment in hospital, the Italian coastguard said.

The western half of the Mediterranean has experienced severe storms since the middle of last week.

Through Sunday night and into Monday morning, a clutch of bad weather passed by the north coast of Sicily.

BBC Weather forecaster Matt Taylor said: "A waterspout is a tornado that has occurred over water rather than land.

"They can form during intense storms, on the base of cumulonimbus/thunder clouds.

"Turbulence, and the wind blowing in slightly different directions around the cloud, can cause rotation under the base of the cloud and the spout to form.

"Like tornadoes, they bring powerful winds, but instead of picking up dust and debris they cause a water mist around the column of rotating air."

The UK Foreign Office said it is supporting a number of British nationals and their families following an incident in Sicily. Britain's Marine Accident Investigation Branch is also sending a team of inspectors to conduct a "preliminary assessment" into the sinking of the UK registered-boat.

The Bayesian's registered owner is listed as Revtom Ltd. The superyacht can accommodate up to 12 guests in six suites.

The yacht's name is understood to be based on the Bayesian theory, which Mr Lynch's PhD thesis was based on.

Mr Lynch's wife Ms Bacares is named as the sole legal owner of Revtom registered in the Isle of Man.

A spokesperson for Camper and Nicholsons International, the firm that manages the 2008-built boat, told BBC Verify: "Our priority is assisting with the ongoing search and providing all necessary support to the rescued passengers and crew."

Mr Lynch sold his company Autonomy to American computing giant Hewlett-Packard (HP) in 2011 for $11bn (£8.6bn).

But an intense legal battle following the high-profile acquisition loomed over Mr Lynch for over a decade. He was acquitted in the US in June on multiple fraud charges, for which he had been facing two decades in jail.
