Apple revises DMA compliance for App Store link-outs, applying fewer restrictions and a new fee structure

Apple has further revised its compliance plan for the European Union's Digital Markets Act (DMA) rulebook, which, since March, has forced it to give iOS developers more freedom over how they can distribute and promote their content on its mobile platform. The iPhone maker is already under investigation by the European Commission for suspected noncompliance with the DMA -- a market contestability regulation that allows for fines of up to 10% of global annual turnover for violations (or 20% for repeat offenses). David Boies Is in Delta’s Corner—and Faces an Old Foe

David Boies catapulted to a new level of fame more than 25 years ago after he won a landmark antitrust case against Microsoft on behalf of the federal government. In the autumn of his storied legal career, he’s staring down his former adversary again.

Delta Air Lines turned to the 83-year-old lawyer after a sweeping tech outage last month affected millions of Microsoft users and hit the airline particularly hard . One of Boies’s oldest clients, Delta has pointed the blame at Microsoft and cybersecurity company CrowdStrike—and is threatening to sue. Microsoft in turn says the fault lies with Delta for dated infrastructure. It’s a remarkable public spat between the software giant and a top client.

If the two sides can’t reach a detente, their dispute could land in court in a matter of weeks. That would place Boies in a familiar position: the national spotlight. He has long been a fixture of some of the legal system’s most captivating cases, sometimes lauded, other times vilified.

He represented Vice President Al Gore before the Supreme Court in the case that ultimately settled the 2000 presidential election. A decade later, he helped secure same-sex marriage rights in California.

Boies also represented Theranos, the disgraced blood-testing company, and movie mogul Harvey Weinstein, who was later convicted of sex offenses. Boies didn’t represent Weinstein in connection with criminal charges. His tactics on behalf of both clients drew public criticism and discomfort from some other clients and colleagues. Boies has said all clients deserve nothing less than zealous advocacy.

In the Microsoft antitrust case, Boies, working for the Justice Department as a special counsel, convinced a federal judge that the company illegally squelched competition to preserve its Windows monopoly and extend it to the web-browser market. The judge ordered a breakup of Microsoft, a remedy that was overturned on appeal. The company ultimately reached a settlement, agreeing to change its commercial behavior. The pact arguably opened the door for a new wave of innovation at the dawn of the internet age.

Boies has brought a litany of private antitrust cases in the years since, and in recent years has frequently sued other top tech companies, including Google.

He is now one of the highest-paid litigators in the U.S., at $2,350 an hour.

Clients are willing to pay so much because of his fearsome reputation as much as for his actual legal acumen.

“There’s a boatload of creative lawyers out there who aren’t him, but when you want to make a splash, hiring a big-name lawyer is not an unusual strategy,” said Nancy Rapoport, a law professor at the University of Nevada-Las Vegas. “Clients hire him not necessarily because they expect to win, but because he can give them leverage for a potential settlement.”

Big tech v. big customer

CrowdStrike said a bug in a quality-control tool that it uses to check system updates allowed a critical flaw in 8.5 million machines running Microsoft Windows. The outage hampered activity across a range of businesses.

With thousands of canceled flights over several days, Atlanta-based Delta faced deeper disruptions than its competitors, prompting a U.S. Department of Transportation investigation over how it handled the meltdown and treated customers. Delta’s chief executive said the outage potentially cost the airline half a billion dollars in five days.

In late July, Boies in letters to Microsoft and CrowdStrike warned of potential legal action, citing severe harm to Delta’s “business, reputation, and goodwill.”

The threats hinted at the outlines of Delta’s potential legal arguments, based on theories of gross negligence. CrowdStrike, he alleged, didn’t properly test and validate its update. And he said he believed Microsoft also acted negligently and “has failed to comply with contractual requirements.”

Mark Cheffo, a lawyer representing Microsoft, said in a written retort that the airline’s comments have been “incomplete, false, misleading, and damaging to Microsoft and its reputation.”

CrowdStrike apologized to Delta but said it strongly rejected allegations that it was negligent or committed willful misconduct.

“Public posturing about potentially bringing a meritless lawsuit against CrowdStrike as a long-time partner is not constructive to any party,” the company said in a statement. “We hope that Delta will agree to work cooperatively to find a resolution.”

If Delta moves forward with a suit, Boies could face a difficult path to victory.

Software companies like Microsoft typically use licensing agreements to shield themselves from liability for outages, said Ifeoma Ajunwa, a law professor at Emory University.

Courts can opt not to enforce such agreements if they are clearly unfair or the result of uneven bargaining power, Ajunwa said, but that is a high bar for Delta to meet.

Boies isn’t daunted.

“The critical cases that I’ve done have often been pushing the law and dealing with a new frontier,” Boies said in an interview. “In a way, that is always controversial: whenever you are moving the law.”

The quiet litigator

Boies favors lower-cost suits, shoes and wristwatches.

A judicious risk-taker with a quiet style, Boies doesn’t fit the stereotype of a theatrical trial lawyer. He owns several properties, including a home in Westchester County, N.Y., and a Northern California ranch that is home to his family-owned and -operated vineyard. He regularly sails on a 180-foot oceangoing yacht, has an extensive wine collection, and has gone on more than a dozen African safaris. But he eschews designer attire, opting instead for modest brands such as Sears and Lands’ End, black Nike sneakers, and affordable wristwatches that he says “don’t set off metal detectors.”

Born in rural Illinois to two teachers and later moved as a teen to Compton, Calif., he struggled to read as a child due to dyslexia . He eventually went to the University of Redlands, near Los Angeles, where he thrived in debate, and later graduated from Yale Law School. Author Malcolm Gladwell included Boies’s story in “David and Goliath,” a 2013 book about underdogs who overcame obstacles and disadvantages.

Boies spent the first 30 years of his law career at Cravath, Swaine & Moore in New York, until he left in 1997 to co-found his own firm, Boies Schiller Flexner, whose successes—and challenges—have been closely aligned with his own.

For years, the firm’s future has been near the top of his mind. Boies Schiller in 2019 named two lawyers to lead the firm’s second generation, but both left in relatively short order.

Last year, Boies formed a new plan to step down as chairman of the firm at the end of 2024, though he said he has no intention to quit practicing law. Today the firm has about 170 lawyers and $250 million in revenue, which increased 14% last year.

A crystal gavel was a gift from a client.

Boies said he may take a more “relaxed trajectory” moving forward, working on fewer cases, but so far, the octogenarian has shown few signs of slowing down.

His firm recently received its share of attorneys’ fees from a $2.7 billion antitrust settlement Boies and others secured with Blue Cross Blue Shield, a case that stretched more than a decade. He also obtained recent large settlements against JPMorgan Chase and Deutsche Bank , on behalf of Jeffrey Epstein accusers who alleged the banks ignored red flags about the financier.

In addition to the Delta engagement, Boies also has ongoing federal antitrust and privacy lawsuits against Google. He settled another earlier this year that alleged the company tracked people without their knowledge. Google in that case agreed to destroy a trove of data that reflected millions of users’ web-browsing activity. This month Boies argued for more than $217 million in attorneys’ fees for the plaintiffs. As part of that case, his firm filed more than 90,000 separate claims in California state court for individual financial damages related to privacy violations.

Google spokesman José Castañeda said Boies’s firm “has filed a number of baseless lawsuits against us that haven’t withstood the scrutiny of a courtroom. ”

This month the firm also filed suit against Meta Platforms, alleging its Instagram app is harmful to minors. Meta didn’t respond to a request for comment.

Among other cases, Boies is representing crypto customers who lost money in the collapses of  FTX and crypto-brokerage firm Voyager. He’s also pressing a long-shot effort on behalf of marijuana companies that are suing to strike down federal cannabis restrictions .

“In the last 90 days, I have been in seven different courts, in seven different cases, and in five states including the District of Columbia,” Boies said. “It’s been the confluence of a lot of cases hitting at one time.”

‘The critical cases that I’ve done have often been pushing the law and dealing with a new frontier,’ Boies said.

In the day and age of expensive luxury yachts, it's not every day you see a historic steamboat take to the water.

But according to owner Ken Goodman, crabbing trips on the SL Louisa with a steam crab cooker and home brew on board are "pure luxury living".

The 79-year-old former carpenter, who takes his hammer and nail bag everywhere he goes, built the vessel in 1987 at his home using an original engine made in Coventry, England in 1880.

"It's a double acting steam engine, 4-inch bore, 7-inch stroke," he said.

"It came out of a sugar mill somewhere up north, a mate gave it to me, so I built the boat to go with it."

Mr Goodman said the engine was in pieces when he took it home and as he recounted the process of fixing it, he joked that "a user manual from 1880 was pretty hard to find".

The vessel had two boilers in its lifetime that ran on coal or timber but the old engine has always performed well.

"If today's modern car engines would last as long as this 1880 job, we'd be a lot better off … it's all throwaway stuff [now]," Mr Goodman said.

The steamboat has no electric lighting, just an oil-based hurricane lamp that hangs at the front.

Bay adventures

Most of the steamboat's adventures in the past 37 years, with its gruff sea-dog skipper, have been around the bay islands in south-east Queensland, including blasting its whistle to start inter-island cross-channel tug-of-war events between Macleay and Lamb islands.

It also raced a New Zealand steamboat called PUKE on the Brisbane River during Expo 88.

"We raced from the Story Bridge round to Expo but he beat me," Mr Goodman said.

But more recently, Mr Goodman has struggled to manage his beloved steamboat on his own.

"It was getting too bloody heavy for me to get off the slip down on Lamb Island," he said.

"I needed a couple of chaps to help me. Most of my mates have dementia or crook backs or have died."

New era for SL Louisa

Rather than send it to a museum, Mr Goodman decided it was time to pass the baton to his son, Lance.

"My son is a builder in Rockhampton and so he said he'd put it on the Fitzroy [River]."

Lance and his father gave the steamboat its maiden voyage in central Queensland in the fresh water, at the Fitzroy River Barrage.

While it was the end of an era for Steamboat Ken, it was the start of a new one for SL Louisa's new captain.

"It's exciting to be able to get it moving, get it in a different river system," Lance Goodman said.

"I've grown up on it my whole life, so I've known how to operate it since I was 10 years old."

SL Louisa was given both a warm send-off from the south-east and welcome to central Queensland.

"When we went and pulled it off Lamb Island, it had vines growing up through the motor because it was on the slipway," Lance Goodman said.

"We had everyone heading upstream at their houses running out, waving to us."

Lance Goodman said he planned to tidy up the boat for new adventures and perhaps showcase it at the next Riverfest 2025 in Rockhampton.
